495 <br /> <br />Item 13b <br />Request to Use Vacant City Lot to Sell Christmas Trees <br /> <br /> Mr. Roush presented his report (SR 89:476) regarding the <br />matter. <br /> <br /> Mr. Butler inquired if this would fall under the category <br />that would require a conditional use permit. <br /> <br /> Mr. Roush replied that the applicant would have to go through <br />a Planning Department permit procedure. Other than that, it would <br />be consistent with the Code. <br /> <br /> Mr. Mercer indicated that he was not in favor of renting out <br />City property for a commercial enterprise to sell Christmas trees <br />and would not support the request. <br /> <br /> Mr. Butler concurred with Mr. Mercer. <br /> <br /> It was moved by Mr. Mercer, and seconded by Mr. Brandes, that <br />Resolution No. 89-492 be adopted, denying the request to use a <br />vacant city lot to sell Christmas trees. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Butler, Mohr, Tarver and Mayor <br /> Mercer <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br /> <br />Item 13c fItem 4p) <br />Health and Welfare Benefits Provided to the City Council. <br /> <br /> Mr. Roush presented his report (SR 89:488) regarding the <br />matter. <br /> <br /> Mr. Mercer inquired if these were new benefits being offered <br />to the Councilmembers. <br /> <br />Mr. Roush replied that since 1985, when the Councilmembers <br />became eligible members of the Public Employees Retirement System <br />(PERS), they have been entitled to all the benefits outlined in <br />the staff report, except Item A.2. - Retirement Benefits. He <br />explained that this benefit was added to the Management <br />Compensation Plan, approved by the Council in October 1988, to <br />which the Councilmembers are likewise entitled. However, there is <br />no documentation that Council is entitled to these benefits. He <br />stated that a resolution clarifying the health and welfare <br />benefits to which the Councilmembers are entitled is in order <br />should questions on the matter arise in the future. <br /> <br /> Mr. Mercer asked what Councilmembers would be entitled to <br />when they retire. <br /> <br /> -16- <br /> 11-21-89 <br /> <br /> <br />
