417

Mr. Abney explained that light and medium shakes are the
same; that there are only heavy and medium-light shakes. It would
cost about 30% more to convert medium non-rated roofs to medium
rated roofs.

Mr. Butler agreed that the difference in cost is definitely a
good investment, but emphasized that he would not want to mandate
that on every resident of the City. He added that any homeowner
who wanted to re-roof his houses should be able to decide on his
own without the City telling him what to do.

Mr. Mercer added that it is possible a resident would choose
not to re-roof if he had to spend 30% more, which makes it more of
a fire hazard.

Mr. Brandes stated that the ordinance may look like there is
too much government imposition, but this is called for as it
involves the life and safety of people.

Mr. Mercer indicated that he was opposed to the ordinance as
he could not impose an additional 30% cost on the people who wish
to change their roofs.

It was moved by Mr. Brandes, and seconded by Mr. Tarver, that
Ordinance No. 1432 be adopted, amending Section 1 of Ordinance No.
1234, requiring the use of fire retardant roof materials within
the City of Pleasanton and adopting findings of facts to support
the imposition of requirements which are greater than the
requirements established by the State Building Standards Code.
The roll call vote was as follows:
AYES: Councilmembers Brandes, Mohr and Tarver
NOES: Councilmember Butler and Mayor Mercer
ABSENT: None
ABSTAIN: None

Item 10b
Ordinance 1433, An Ordinance of the City of Pleasanton amending
Section 1 of Ordinance 1297 and Section 20.08.025 of the
Pleasanton Municipal Code, requiring existing dwellings to be
retrofitted with spark arrestors

Mr. Mercer opened the discussion on the matter. He asked Mr.
Hill how this ordinance would be enforced.

Mr. Hill stated that as a City ordinance. the legal ~rocess
would De applied. Violators would be notified and given a
reasonable time to make the correction. If they still do not
comply, the Infraction Ordinance would be exercised: they would
be fined, the violation would be considered a misdemeanor, and it
would be taken as far as necessary.

-15-
10-31-89
