349 <br /> <br /> Mr. Mercer declared the public hearing open on the <br />application. <br /> <br /> Mr. Darryl Alexander, 849 Montevino Drive, referred to the <br />staff report section indicating that on two days the past week, <br />ten construction workers were observed to have entered the <br />construction site through Vineyard Avenue and Montevino Drive <br />rather than through Crellin Road and inquired if there were <br />figures on residents of the area using that outlet instead of the <br />neighborhood street. <br /> <br /> Mr. Roush replied that only construction workers were <br />counted. <br /> <br /> Mr. Alexander commented that the removal of the barricades <br />appears to have helped traffic circulation in the area. <br /> <br /> Ms. Mary Pat Hawkins, 865 Montevino Drive, stated that she <br />drives back and forth to the school four times a day and having <br />the barricades up is very inconvenient. <br /> <br /> Mr. Tarver recommended that in the future, projects ought to <br />be approved in such a way as to avoid situations like this one. <br />Occupancy should not be allowed until the project is completed. <br />Additionally, there should be some way of taking away an approval <br />that has been granted if the conditions of approval are not <br />followed. This would protect those who work in good faith with <br />the City. <br /> <br /> Mr. Brandes indicated that he strongly agreed with Mr. Tarver <br />and asked what kind of enforcement is currently being used in the <br />project. <br /> <br /> Mr. Swift replied that since the barricades came down, <br />a police officer has gone to the site to observe whether or not <br />violations have been going on, and they have. However, nothing <br />has been done about those violations. <br /> <br /> Mr. Brandes inquired why these violators are not being <br />cited. <br /> <br /> Mr. Roush answered that the primary reason is a court order <br />which suggests that if construction workers use Crellin Road <br />occasionally, they cannot be cited; neither can stop work orders <br />be issued. The problem becomes a matter of what constitutes a <br />reasonable or occasional use of Crellin Road.
