277 <br /> <br />9. CITY COUNCIL COMMITTEE REPORTS <br /> <br /> There were no City Council Committee Reports presented at <br />this meeting. <br /> <br />10. MATTERS CONTINUED FOR DECISION <br />Item 10a <br />Adoption of Ordinance No. 1431, Amending the Pleasanton Municipal <br />Code by addinq thereto a new Chapter 9.28 to Title 9 (Health and <br />Safety) Concerninq Property Maintenance <br /> <br /> Mr. Mercer opened the discussion on the matter. <br /> <br /> Mr. Tom Pico, 795 Neal Place, reemphasized his concerns about <br />the ordinance being poorly drafted, more extensive than necessary, <br />with vague and ambiguous definitions and unreasonably expanding <br />the powers of the City Manager and Council. He pointed out that <br />it did not provide for citizen complaints against the City and <br />added that the Small Claims Court could be utilized to resolve <br />problems and issues addressed by the ordinance and requested the <br />Council to give it serious consideration before adoption. <br /> <br /> Mr. Mercer explained that the ordinance came out of the fact <br />that other ordinances are not effective and cannot accomplish the <br />clean up that the City wants. <br /> <br /> Ms. Mohr commented that there are occasions when the City <br />needs all the tools at its disposal to address unusual and unique <br />problems. This ordinance provides that tool. <br /> <br /> Mr. Butler stated that he found this ordinance to be less <br />objectionable than the original. He indicated that he did not <br />endorse everything Mr. Pico said, but he still considers the <br />ordinance too broad and would not support it. <br /> <br /> Mr. Tarver mentioned that he concurred with Mr. Mercer's <br />statement that some City problems could not be resolved by <br />existing ordinances. <br /> <br /> It was moved by Mr. Mercer, and seconded by Mr. Tarver, that <br />Ordinance 1431 be adopted, amending the Pleasanton Municipal Code <br />by adding thereto a new Chapter 9.28 to Title 9 (Health and <br />Safety) concerning property maintenance. <br />The roll call vote was as follows: <br />AYES: Councilmembers Mohr, Tarver and Mayor Mercer <br />NOES: Councilmember Butler <br />ABSENT: Councilmember Brandes <br />ABSTAIN: None <br /> <br /> Mr. Mercer inquired when the ordinance would be effective. <br /> Mr. Roush replied that it would take effect in 30 days. <br /> <br /> -19- <br /> 9-5-89 <br /> <br /> <br />
