193 <br /> <br />Item 7b <br />Proposed FAA Rule to Establish Prohibited Airspace Around <br />Livermore Airport <br /> <br /> Mr. Swift presented his report (SR 90:162) regarding the <br />matter. <br /> <br /> Mr. Brandes asked Mr. Butler if the concerns he expressed at <br />the last meeting were met by the Staff Report. <br /> <br /> Mr. Butler said yes. He pointed out that because of some <br />publicity about a change in what had been requested, the <br />Department of Energy's original proposal of an 80 square mile <br />restricted area has been reduced to 25 square miles. However, the <br />impact would still be the same on the primary and instrument <br />landing patterns. He indicated that the draft resolution is <br />appropriate. <br /> <br /> It was moved by Mr. Butler, and seconded by Mr. Brandes, that <br />Resolution No. 90-83 be adopted, opposing the imposition of <br />prohibited airspace around the Livermore Airport and directing <br />staff to forward the resolution to the Federal Aviation <br />Administration (FAA). <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Butler, Mohr, Tarver and Mayor <br /> Mercer <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br /> <br />8. MATTERS INITIATED BY COUNCILMEMBERS <br />Item 8a <br />Annexation Requests on Vineyard Avenue, East of the Existing City <br />Limits Line <br /> <br /> Ms. Acosta presented her report (SR 90:161) regarding the <br />matter. <br /> <br /> Mr. Peter MacDonald, 400 Main Street, representing James and <br />Susan McDowell with respect to their Victorian Vineyard Avenue <br />project, stated that a traffic study done in connection with the <br />project indicated that Vineyard Avenue is at Level Service A and <br />that the development will not push Vineyard Avenue beyond that <br />level. He added that the Council's decision regarding the Heinz' <br />annexation request indicated that there would be no need for a <br />benefit district for the area between the City limits and the <br />South Livermore Valley Study. This would jeopardize the <br />McDowells' project because without the benefit district, there <br />would be no one to pay for the Vineyard Avenue realignment, and <br />one of the conditions of approval for the Victorian project to <br />start is the completion of the Vineyard Avenue realignment. He <br />stated that the McDowells were willing to pay their fair share of <br />the realignment and requested that this condition of approval be <br />removed so the project can proceed. <br /> <br /> - 7 - <br /> 4-17-90 <br /> <br /> <br />
