182

Mr. Mercer pointed out that staff has not done anything
except respond to a letter submitted by the applicant. He
explained that the Heinz's property is right next to Ruby Hills,
and that the Heinz's would like their property to be annexed into
the City of Pleasanton and be under the City's control rather than
the County's.

Mrs. Sharon Heinz stated that she and her husband have no
intentions of building and developing their property at this time,
but that they still want to build their home there. She added
that they would like to-be in the City of Pleasanton, where the
people look out for one another's interest.

Mr. Brandes inquired if the property is at the end of the
Fertile Crescent study.

Mrs. Heinz said yes. She added that the property's being in
the County is what she is most concerned about.

Mr. Mercer stated that if the Heinz property is annexed, the
City will have to annex all the properties between the present
City limits and that property. He asked Mrs. Heinz if she knew
how the neighbors felt about annexing their properties.

Mrs. Heinz replied that she knew of only two neighbors who
did not want to come into the City. She added that she and her
husband had no intention of moving into the City limits until it
became appropriate, and they felt that now is the appropriate
time.

Mr. Brandes indicated that he was not opposed to having the
property annexed to the City of Pleasanton. He explained,
however, that when he made the motion earlier, the intention was
that no properties within the Fertile Crescent Study area would be
considered until the Study has been completed and the Council has
had a chance to review it.

Mr. Mercer stated that he thinks that as far as the Fertile
Crescent Study is concerned, it would make no difference if the
property were within or outside the City limits.

Ms. Mohr stated that it was her understanding that the
EIR would be ready within 60 sixty days, in which case, the City
could use the EIR as part of the City's Vineyard Avenue corridor
study. She added that if the County approves Ruby Hills, the
traffic impact on Vineyard Avenue would be tremendous; she would
therefore like the City to have control over what happens on that
corridor. However, she would prefer to bring the entire area into
the City as a single block.

- 18 -
4-3-90
