119 <br /> <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Mohr, and Mayor Mercer <br />NOES: Councilmembers Butler and Tarver <br />ABSENT: None <br />ABSTAIN: None <br /> <br />Item 6c <br />GP-90-01, PUD-81-30-23M, and PUD-81-30-50D, The Prudential <br />Insurance Company of America, Applications for the Following City <br />Actions on Lot 24A of the Hacienda Business Park, an Approximately <br />12.4 Acre Site Bounded by Stoneridge Drive, the Arroyo Mocho <br />Canal, Tassajara Creek, and West Las Positas Boulevard: GP-90-1, <br />Application to Change the General Plan Land Use Element on Lot 24A <br />from Business Parks (Industrial/Commercial and Offices) to High <br />Density Residential (8+ Dwelling Units per Gross Acre); <br />PUD-81-30-23M, Application to Rezone Lot 24A from the PUD-I/C-O <br />District to the PUD-HDR District and to Retain the Present Maximum <br />Commercial/Office/Industrial Floor Area in the Balance of the <br />Business Park; and PUD-81-30-50D, Application to Approve the Site- <br />Specific Development Plan on Lot 24A for 153 Townhouse Units and <br />Associated Parking, Driveway, and Landscape Improvements <br /> <br />Consider Adoption of a Negative Declaration <br /> <br /> Mr. Swift presented his report (SR 90:108) regarding the <br />matter. <br /> <br /> Mr. Mercer declared the public hearing open on the <br />application. <br /> <br /> Mr. Roger Swanson, Vice President of Summerhill Development <br />Company, thanked the staff for its comprehensive report and <br />stated that he agreed with all the conditions of approval. He <br />indicated that he concurred with Condition 5h that the developer <br />hold 10-15 units for a reasonable period of time for first-time <br />homebuyers and pay an affordable housing fee of $100,000 in <br />addition to all other normal City fees. He requested, however, <br />that this fee be paid with the building permits rather than at the <br />filing of the first final map covering the project, which precedes <br />any development on the project. In connection with Condition 5j, <br />he stated that he had proposed to staff that the building permits <br />be issued at the point when the traffic counts and the start of <br />the Hacienda Drive/I-580 Interchange construction show that the <br />level of service is acceptable, rather than at the commencement of <br />construction of the final stage of the Hacienda Drive/I-580 and <br />Santa Rita Road/I-580 Interchanges. <br /> <br /> Mr. Butler asked Mr. Swanson if he were agreeable to both <br />parts of Condition 5h regarding reserving 10-15 units for <br />first-time buyers and paying the affordable housing fee. <br /> <br /> Mr. Swanson replied that he was. <br /> <br /> - 11 - <br /> 3-20-90 <br /> <br /> <br />
