36

she was not aware that there was an annexation request for the
Lemoine property. She expressed concern that 15 acres of the
property are included in the West Pleasanton Annexation
Feasibility Study.

Mr. Brandes stated that this is one step in a very long
process and that there will be public hearings along the way. He
emphasized that prezoning the property does not mean that any
particular type of development will be approved for the site. The
Council is very concerned about the property as it relates to the
hillsides; however, it does not have any control over that
property until it is annexed to the City.

Mr. Mercer explained that all that is being done at this time
is prezoning the property. The applicant has requested that the
property be annexed to the City. The Council's position is that
if the property is annexed, the City would gain control over the
property. Otherwise, the property would remain within the
jurisdiction of Alameda County, and it would be the County that
would decide what kind of development can happen on the property.

It was moved by Mr. Brandes, and seconded by Ms. Mohr, that
the following items listed on the Consent Calendar be approved:

a. Approval of City Council Minutes for 1/2/90.

b. Adoption of Ordinance No. 1447, approving the
application of the City of Pleasanton to prezone an
approximately 48.4 acre site located on the west side of
Foothill Road, opposite Oak Creek Drive, to the PUD
(Planned Unit Development) - Low/Rural Density
Residential District (33 acres), and the "A"
(Agricultural) District (15 acres).

c. Adoption of Ordinance No. 1448, amending Chapter 20.40
(Swimming Pools), Title 20 (Building and Construction)
of the Municipal Code of the City of Pleasanton.

d. Adoption of Ordinance No. 1449, amending Sections 1, 2,
3, 4, 5, 6, 7 and 8 of Ordinance No. 1169, as amended,
and amending Sections 20.04.010, 20.08.010, 20.08.070,
20.12.010, 20.16.010, 20.20.010, 20.24.010, 20.24.030,
20.28.010 and 20.32,010 of the Pleasanton Municipal
Code, by adopting by reference the 1988 Uniform
Administrative, Building, Plumbing, Mechanical, Fire,
and Housing Codes, and the 1987 Electrical Code and
adding to the Pleasanton Municipal Code a new Chapter
20.34, adopting by reference the Uniform Sign Code, 1988
Edition.

-2-
1-16-90
