Mr. Butler explained that all the Councilmembers are very concerned about what happens to the Ridge. The only way for the Council to do anything about that concern is to annex those lands and bring them under City control. If Council does not do anything, it loses the opportunity to influence what happens in the area. Ms. Spraggins indicated that she would like to see the Ridgelands preserved and have as little development in that area as possible. It was moved by Mr. Brandes, and seconded by Ms. Mohr, to approve the request for annexation of approximately 174 acres located on the west side of Foothill Road. The roll call vote was as follows: AYES: Councilmembers Brandes, Butler, Mohr, Tarver and Mayor Mercer NOES: None ABSENT: None ABSTAIN: None Item 12b Request from Strizzi's Restaurant for Restaurant Seating, Alcoholic Beverage Service, and Related Commercial Uses on Public Sidewalks in the Downtown Area Mr.. Swift presented his report (SR 90:16) regarding this matter. Mr. Ray Bartolomucci, owner of Strizzi's Restaurant, 649 Main Street, presented the background of his restaurant. He stated that he worked with the Design Review Board throughout the planning stage of the restaurant. The project was approved on August 2, 1990 with the condition that it have outside tables which would be used for a waiting area and for serving appetizers, wine and beer to complement the food. When the final inspection for occupancy was done on November 15, 1989, the building inspectors inquired why there were tables on the sidewalk. The different city officials recognized that there had been a miscommunication problem, and finally on December 2, 1989, an encroachment permit was issued allowing the outside tables. When the Alcoholic Beverage Control (ABC) inspectors came to make their final inspection, the City would not allow ABC to inspect the outside area because the City felt it needed to work on it. He continued that an article written by Ms. Lisa Baker on the January 2nd issue of The Valley Times noted some points brought up by the community and some Councilmembers about the restaurant. The article mentioned that Police Chief Bill Eastman stated that any permit that would allow the restaurant to serve alcohol on the sidewalk would violate State law prohibiting drinking in public, including on City streets, sidewalks and in parking lots.
