Mr. Butler explained that all the Councilmembers are very <br />concerned about what happens to the Ridge. The only way for the <br />Council to do anything about that concern is to annex those lands <br />and bring them under City control. If Council does not do <br />anything, it loses the opportunity to influence what happens in <br />the area. <br /> <br /> Ms. Spraggins indicated that she would like to see the <br />Ridgelands preserved and have as little development in that area <br />as possible. <br /> <br /> It was moved by Mr. Brandes, and seconded by Ms. Mohr, to <br />approve the request for annexation of approximately 174 acres <br />located on the west side of Foothill Road. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Butler, Mohr, Tarver and Mayor <br /> Mercer <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br /> <br />Item 12b <br />Request from Strizzi's Restaurant for Restaurant Seating, <br />Alcoholic Beverage Service, and Related Commercial Uses on Public <br />Sidewalks in the Downtown Area <br /> <br /> Mr.. Swift presented his report (SR 90:16) regarding this <br />matter. <br /> <br /> Mr. Ray Bartolomucci, owner of Strizzi's Restaurant, 649 Main <br />Street, presented the background of his restaurant. He stated <br />that he worked with the Design Review Board throughout the <br />planning stage of the restaurant. The project was approved on <br />August 2, 1990 with the condition that it have outside tables <br />which would be used for a waiting area and for serving appetizers, <br />wine and beer to complement the food. When the final inspection <br />for occupancy was done on November 15, 1989, the building <br />inspectors inquired why there were tables on the sidewalk. The <br />different city officials recognized that there had been a <br />miscommunication problem, and finally on December 2, 1989, an <br />encroachment permit was issued allowing the outside tables. When <br />the Alcoholic Beverage Control (ABC) inspectors came to make their <br />final inspection, the City would not allow ABC to inspect the <br />outside area because the City felt it needed to work on it. <br /> <br /> He continued that an article written by Ms. Lisa Baker on the <br />January 2nd issue of The Valley Times noted some points brought up <br />by the community and some Councilmembers about the restaurant. <br />The article mentioned that Police Chief Bill Eastman stated that <br />any permit that would allow the restaurant to serve alcohol on the <br />sidewalk would violate State law prohibiting drinking in public, <br />including on City streets, sidewalks and in parking lots. Mr. <br />Bartolomucci stated that alcohol beverage can be served on <br /> <br /> -18- <br /> 1-16-90 <br /> <br /> <br />
