Mr. Brandes commented that most pool equipments run very <br />efficiently when new but become noisy as they get old or are not <br />properly maintained. <br /> <br /> Mr. Mercer indicated that the ordinance would allow the staff <br />some flexibility in putting in spas and swimming pools in smaller <br />back yards, which are being built more in town. At the same time, <br />the ordinance provides for noise attenuation, thereby assuring <br />better installation. <br /> <br /> Mr. Brandes inquired how the ordinance would take care of <br />problems that come up after installation. <br /> <br /> Mr. Swift replied that the City's noise ordinance would take <br />care of these problems. If noise cause by the equipment exceed <br />the allowed noise limit and a neighbor complains, the City would <br />come in and check it out. The City can then require the owner to <br />attenuate the noise. <br /> <br /> Ms. Mohr commented that this ordinance would make a healthy <br />recreation available to owners of the small lot developments that <br />Council has been approving in an attempt to address the <br />affordable housing issue. She recommended approval of the <br />application, as presented. <br /> <br /> It was moved by Ms. Mohr, and seconded by Mr. Butler, that <br />Ordinance No. 1448 be introduced, to be read by title only and <br />waiving further reading thereof, approving RZ-89-8, the <br />application of the City of Pleasanton to amend the Municipal Code <br />regarding provisions for setbacks for pool equipment and spas. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Butler, Mohr, Tarver and Mayor <br /> Mercer <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br /> <br />7.
