Brandes inquired whether the August 10, 1988 map was the <br />original plan map. <br /> <br /> Mr. Swift replied that it was the house siting plan that was <br />prepared by Mr. Gooch and approved by the Planning Commission. He <br />explained that some changes were made on these plans for some of <br />the houses for lots that Mr. Gooch then sold as custom lots. <br /> <br /> Mr. Tarver indicated that this was a no-win situation and that <br />Mr. Schneider would like to get out of the process what he thought <br />he was going to get. He added, however, that since Lot 20 is not <br />an impact lot, it would not be appropriate to support the appeal. <br /> <br /> Mr. Mercer stated that some people get confused with issues <br />that have been decided by the City Council and the Planning <br />Commission and are then interpreted and decided on differently by <br />the Planning Department. He indicated that he would support <br />Ms. Shrimali because a substantial amount of money had been <br />invested in the house and moving the foundation another 6.5 feet <br />would not solve anything. <br /> <br /> Mr. Brandes indicated that he strongly concurred with the <br />Mayor that something needed to be done regarding interpretations of <br />Council decisions. He suggested that very specific policies be <br />formulated with regard to Floor Area Ratio (FAR) as it relates to <br />building pads. <br /> <br /> It was moved by Mr. Tarver, and seconded by Ms. Mohr, that <br />Resolution No. 90-148 be adopted, denying AP-90-12, the appeal of <br />Ron Schneider, thereby upholding the determination of the Planning <br />Department that the building permit issued to Sammy Shrimali to <br />construct a single-family residence is in compliance with the <br />~pproved Planned Unit Development located at 2853 Victoria Ridge <br />Court (Tract 5908, Lot 20). <br />The roll call vote was as follows: <br />AYES: Councilmembers Mohr, Tarver and Mayor Mercer <br />NOES: Councilmember Brandes <br />ABSENT: Councilmember Butler <br />ABSTAIN: None <br /> <br />Item 7c <br />Z-90-326, Application of Charles R. Suer for Proposed Regradinq <br />Approval in the Rear Yard of an Existing Residential Lot (Lot 3).in <br />the Vintaqe Heights II Development Located at 949 Montevino Drive <br /> <br /> This item was continued to the August 21st City Council <br />Meeting at the request of staff. <br /> <br /> <br />
