365

The roll call vote was as follows:
AYES: Councilmember Brandes, Butler, Mohr, and Tarver
NOES: None
ABSENT: None
ABSTAIN: Mayor Mercer

It was further moved by Mr. Brandes to deny PUD-80-16-7D, the
application for design review approval for a five-building,
approximately 46,300 square foot commercial center on a 5.4 acre
site generally located on the northeast corner of Stoneridge Drive
and Hopyard Road.

The motion failed for lack of a second.

Mr. Butler stated that Mr. Brandes' concern about having too
many retail centers in the City is valid but indicated that retail
centers contribute to an integrated business atmosphere and provide
needed services. He added that the Council's task was to look into
site planning rather than to determine market forces.

Mr. Tarver commented that the developer has been sensitive to
the neighbors' concerns and that the redesigned project was an
improvement over the previous plan. He disagreed with Mr. Butler's
statement regarding the Council's task but stated that this retail
development was not an overstatement of what was needed by the
community in the area.

Ms. Mohr commented that the project design was appealing and
agreed that it was an improvement over the past design. She
indicated that having some retail use would be appropriate and
would be appreciated by the employees in the area as well as by the
general community. She stated that free market dictates specific
uses, and the Council's task is to determine whether or not the
site, zoning, and design are appropriate.

It was moved by Mr. Butler, and seconded by Mr. Tarver, that
Resolution No. 90-141 be adopted, approving PUD-80-16-7D, the
application for design review approval for a five-building,
approximately 46,300 square foot commercial center on a 5.4 acre
site generally located on the northeast corner of Stoneridge Drive
and Hopyard Road, as set forth in the Staff Report.
The roll call vote was as follows:
AYES: Councilmember Butler, Mohr, and Tarver
NOES: Councilmember Brandes
ABSENT: None
ABSTAIN: Mayor Mercer

7-17-90

- 17 -
