The property owners would be guaranteed the right to own <br />their land and use it as the government deems is in the best <br />interest of the public. She said that the citizens' committee is <br />the course Council is taking to plan what would happen in the area <br />and change what the Initiative proposes to do. She emphasized that <br />the Ridge should have a restricted zoning until such time that the <br />citizens' committee is able to come up with actual solutions. She <br />asked what would happen if the citizens' committee plan fails to <br />get a majority vote. <br /> <br /> Mr. Mercer stated that anyone would have the right to referend <br />what the citizens' committee comes up with but that citizens cannot <br />referend the SPRC Initiative. He added that ideally, no decision <br />should be made until the citizens' committee looks at all issues <br />and comes back with a recommendation which he would support. The <br />Council's decision on the recommendation would then go on the <br />ballot. The SPRC Initiative prezones the property but leaves the <br />control of the property with Hayward and Alameda County. <br /> <br /> Ms. Spraggins commented that she was concerned about what the <br />Council would do with the Ridgelands, based on the blanket approval <br />it has given for developments along Foothill Road. She added that <br />Alameda County and Hayward have offered to work with SPRC in trying <br />to find a solution for the Ridgelands while having it under more <br />than one jurisdiction. <br /> <br /> Mr. Tarver pointed out that the SPRC Initiative asks the <br />community what should be done to the Ridgelands in terms of <br />development potential. It does not preclude the citizens' <br />committee from coming up with a plan and getting the general public <br />to agree. <br />agree. <br /> <br /> Mr. Brandes indicated that putting the Initiative on the <br />ballot, not the Initiative itself, is the issue at hand. He added <br />that the Initiative qualifies since it had the required number of <br />signatures, and Council has no choice but to put it on the ballot. <br />He stated that the best way to control an area is to annex it and <br />that the zoning of an annexed area cannot be changed without the <br />complete citizen review and process. <br /> <br /> Mr. Mercer stated that the issue at hand in not the protection <br />of the Ridgelands but the process to be followed in protecting the <br />Ridgelands.
