341 <br /> <br /> Mr. Mercer asked Mr. Roush to explain the City's liability <br />with regard to lighting standards. <br /> <br /> Mr. Roush replied that as expressed by Mr. Brandes, it would <br />be better to have no light than substandard light. He explained <br />that if a substandard light is installed on the road and an <br />accident occurs, the plaintiff's attorney could bring in an expert <br />to say that had it been lit according to the appropriate standards, <br />the accident would not have occurred. He suggested that any lights <br />to be installed should meet the standards that the Engineering <br />Department recommended, and if these standards are not acceptable, <br />it would be better not to have any lights at all. <br /> <br /> Mr. Mercer inquired what the plans were for the Laguna Oaks <br />project. <br /> <br /> Mr. Elliott replied that no plans have been made for the <br />Laguna Oaks project, pending final decision on the project. <br /> <br /> Ms. Acosta stated that the same type of lighting would be <br />recommended all through Foothill Road. <br /> <br /> Mr. Brandes commented that Foothill Road has a semi-rural <br />atmosphere and that it would be inappropriate to have it brightly <br />lit, except at intersections for safety reasons. <br /> <br /> Mr. Mercer stated that what would be most appropriate would be <br />to put the minimum amount of lighting necessary to meet the law and <br />to protect the City from liability. He asked Mr. Elliott what the <br />minimum requirement was. <br /> <br /> Mr. Elliott replied that he felt that the staff recommendation <br />of 150 watts would be the minimum lighting requirement. <br /> <br /> Mr. Brandes inquired if having no lights would be an <br />alternative. <br /> <br /> Mr. Elliott answered that it would be an alternative, although <br />not a viable one. He indicated that there have been some fairly <br />significant accidents along Foothill Road. <br /> <br /> Mr. Innes commented that many of the accidents were caused by <br />the bad design of the "S" turns within Foothill Road as well as the <br />narrowness of the road and the ditches on the side. He added that <br />there are hardly any lights on Foothill Road south of Bernal <br />Avenue, and no accidents have occurred there since the curve was <br />redesigned, the ditches filled and the road widened. <br /> <br /> 7-10-90 <br /> - 25 - <br /> <br /> <br />
