302 <br /> <br />dedicated to Zone 7 and have the City add to its existing <br />agreement with Zone 7 that piece of property as a recreational <br />easement. In that agreement, the City accepts the liability of <br />having the public in that area. There will be no continuous trail <br />that would lead the public into this area until there is a place <br />for the trail to go. The same situation exists on the northeast <br />side of the creek. <br /> <br /> It was moved by Mr. Brandes, and seconded by Mr. Tarver, that <br />Ordinance No. 1473 be introduced, to be read by title only, and <br />waiving further reading thereof, approving PUD-90-6, the <br />application of Division Street Partners for PUD development plan <br />approval to construct nine detached single-family dwelling units <br />on an approximately 1.1 acre portion of an approximately 2.4 acre <br />site located at 1045 Division Street, in the area generally <br />bounded by Division Street and the Arroyo del Valle, as set forth <br />in the Staff Report and subject to the following conditions: <br />(1) Amendment of Condition No. 3d to indicate that 15-gallon trees <br />instead of 24" and 36" box trees would be planted along the creek <br />embankment; (2) Amendment of Condition No. 3e to show that <br />private owners will be responsible for the landscape maintenance <br />for their own property and share in the maintenance of the common <br />area; (3) Amendment of Condition No. 4d to reflect that the <br />original chimney design will be retained in lieu of the brick <br />chimneys; and (4) Condition No. 5f does not apply to the stairwell <br />window. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Mohr, Tarver and Mayor Mercer <br />NOES: None <br />ABSENT: Councilmember Butler <br />ABSTAIN: None <br /> <br />Item 6~ <br />Resolution Confirming the Downtown Pleasanton Advisory Board <br />Report and Levying the 1990-91 Assessment <br /> <br />Mr. Mercer declared the public hearing open on the item. <br /> <br /> Mr. Sandy MacTernan, current president of the Downtown <br />Association, indicated that he was in favor of continuing the <br />assessment district. <br /> <br /> Mr. Mercer thanked Mr. MacTernan for the fine job the <br />Downtown Association did for Heritage Days. <br /> <br /> Mr. A1 Bronzini, 719 Main Street, indicated that he strongly <br />supported the Downtown Association as a very vital link for the <br />businesses in the downtown area. <br /> <br /> Mr. Roger Grossman, publisher of The Tri-Valley Herald, 4770 <br />Willow Road, indicated that there was a direct and positive <br />relationship between the safety, quality and economic heartbeat of <br />the downtown environment and the existence of a viable Downtown <br /> <br />- 26 - <br /> <br />6-19-90 <br /> <br /> <br />
