290 <br /> <br /> Ms. Mohr commented that a rise in the demand for West Las <br />Positas Boulevard would probably mean a similar demand for <br />Foothill Road. She noted that a few years back, a decision was <br />made to keep Dublin Canyon Road narrow to restrict development, <br />which has resulted in traffic problems. She pointed out that the <br />City should have the capability of responding to that issue should <br />it happen on Foothill Road. <br /> <br /> It was moved by Mr. Brandes, and seconded by Ms. Mohr, that <br />Resolution No. 90-109 be adopted, after making the findings set <br />forth in Exhibit "C" of Staff Report No. 90:250, certifying that <br />the Environmental Impact Report has been completed in compliance <br />with CEQA and that Council has considered the information in the <br />Final Environmental Impact Report. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Mohr, Tarver and Mayor Mercer <br />NOES: None <br />ABSENT: Councilmember Butler <br />ABSTAIN: None <br /> <br /> Mr. Brandes asked Mr. Roush is there would be other <br />conditions relating to the cancellation of the Williamson Act that <br />he found appropriate other than those in the Staff Report. <br /> <br /> Mr. Roush replied that Council could incorporate Mr. <br />MacDonald's proposed findings to support the conclusion that the <br />contiguous pattern of urban development is present if the Council <br />agrees with the statements. <br /> <br /> Mr. Tarver indicated that he could not make those findings. <br />He added that the development was premature and the unnecessary <br />conversion of agricultural land was not in the public's interest. <br /> <br /> Ms. Mohr commented that the General Plan reviews have <br />identified the full range of housing needs for the City ranging <br />from large to low income lots. She pointed out that the west side <br />of the Foothill Road corridor and other hilly agricultural areas <br />have always been considered to meet the large lot needs, primarily <br />because density in these areas is logically less than that in the <br />flatlands. She stated that there were other large lots, other <br />than the Garms property, that are waiting for annexation but that <br />it would not be logical to wait until those are annexed. She <br />supported the cancellation of the Williamson Act. <br /> <br /> It was moved by Mr. Brandes, and seconded by Ms. Mohr, that <br />Resolution No. 90-110 be adopted, approving the application of A-M <br />Homes for the cancellation of the Williamson Act Agricultural <br />Preserve Contract and including in the Council records the <br />findings required by Government Code Section 51282 that the Garms <br />project would provide a more contiguous pattern of urban <br />development than the development of any other proximate <br />uncontracted lands. <br /> <br />- 14 - <br /> <br />6-19-90 <br /> <br /> <br />
