289 <br /> <br />Z <br /> <br />district if one is formed to mitigate traffic at the intersections <br />of Stoneridge Drive and West Las Positas Boulevard with Foothill <br />Road. <br /> <br /> Mr. Mercer stated that Council should also discuss a height <br />limit on properties immediately adjacent to Foothill Road. He <br />added that if the Garms project is approved, the issue on public <br />access to the open spaces should be referred to the Park and <br />Recreation Commission. <br /> <br /> Mr. Brandes commented that he had no objection to that <br />proposal but would prefer to have a provision indicating that if <br />the adjoining properties make it feasible and the City decided to <br />have the open spaces accessible to the public, the property would <br />be transferred to the City or the EBRPD. <br /> <br /> Mr. Mercer stated that the Park and Recreation Commission <br />could also consider that. <br /> <br /> Ms. Mohr recommended that the language on Condition No. 9 be <br />modified to reflect the potential for dedication, conditioned on a <br />review by the Park and Recreation Commission. <br /> <br /> Mr. Tarver stated that he concurred with Mr. Brandes that <br />widening Foothill Road would change the rural country lane to a <br />thoroughfare. He pointed out that 13 lots are too visible on <br />Foothill Road and that public access to open space is in the <br />public's best interest. He commented that a traffic signal would <br />be necessary on Highland Oaks if that would be the logical <br />intersection for children from the development to cross to <br />school. <br /> <br /> Mr. Brandes inquired how the dollar amount for the project's <br />contribution to Foothill Road improvements would be determined <br />should Council decide on the land dedication and landscaping. He <br />also asked if there is a language that would allow the <br />contribution to be used in some other traffic projects in the area <br />if the money is not used after a certain period of time. <br /> <br /> Mr. Roush replied that the Traffic Engineer and the Public <br />Works Department can come up with the dollar figure for the <br />Foothill Road improvement. With regard to transferring those <br />funds to some other use not related to that particular project, <br />State Law stated that the funds have to be utilized within five <br />years; otherwise, they are returned to the developer. This period <br />can be extended for another five years, subject to annual review, <br />upon a Council finding that the funds are already committed. <br /> <br /> Mr. Brandes inquired if the funds would be appropriate for <br />the landscaping of West Las Positas Boulevard to Muirwood Drive, <br />if it will not be utilized for the widening of Foothill Road. <br /> <br />Ms. Acosta said yes. <br /> <br />- 13 - <br /> <br />6-19-90 <br /> <br /> <br />
