REPORTS OF THE CITY ATTORNEY
Item 13a
Proposed Amendments to the Pleasanton Municipal Code Concerninq
Terms of Office for Elective Officials and Concerning
Councilmembers' Runnin~ for Mayor

Mr. Roush presented his report (SR 90:449) regarding the
matter.

Mr. Brandes stated that he had requested the amendments
because he felt that anyone who commits himself to running for
another office and loses in the election should not continue in
office.

Mr. Rick Dobbs, 3616 Portsmouth Court, commented that any
elected official has the right to run for a higher post and that he
would like the official to continue to serve should he lose for
that higher post.

Ms. Marcelline Mahern, 4364 Fairlands Drive, stated that
experience has served well in the past and the opportunity for
experienced Councilmembers to run for Mayor should be encouraged
without the Councilmember losing his seat.

Ms. Sharrell Michelotti, 7873 Olive Court, commended Mr.
Brandes for his services to the City. She added that she agreed
with Ms. Mahern's comments and inquired how a vacant Council seat
would be filled if a Councilmember runs for Mayor and loses.

Mr. Mercer replied that Council has the option of either
appointing a new Councilmember or holding an election for the
vacant seat.

Mr. Brandes stated that the comments about experience are
relevant and that nothing in the proposed ordinance precludes
people with experience from running for a higher seat.

- 33 -
11-20-90
