121 <br /> <br /> Mr. Tarver indicated that he would not support the project <br />because of the issues concerning density, grading, traffic impacts, <br />the view from the freeway, affordability, services and facilities. <br /> <br /> Mr. Butler stated that he was opposed to the project because <br />the Planning Commission did not address and make recommendations <br />for many substantive issues on the project. He indicated that he <br />would prefer to have the application return to the Planning <br />Commission for reconsideration. <br /> <br /> It was moved by Mr. Brandes, and seconded by Mr. Mercer, that <br />Ordinance No 1491 be introduced, to be read by title only and <br />waiving further reading thereof, approving AP-90-15/PUD-90-13, the <br />application of Jeannette Westbrook/S & S Properties for rezoning <br />from "A" (Agricultural) to the "PUD" (Planned Unit Development) - <br />Medium Density Residential District and for development plan <br />approval to construct 40 single-family residential units on an <br />approximately nine acre site located at 10890 Dublin Canyon Road, <br />as set forth in the Staff Report, subject to the following <br />conditions: (1) that a tot lot be developed on the flat area near <br />Dublin Canyon Road; (2) that 12 trees be planted on the <br />northeastern portion of the property to shield the Canyon Meadows <br />project; (3) that Condition No. 5 of the Conditions of Approval <br />regarding one-story units and Condition No. 25 regarding the tree <br />study be deleted; (4) that the slope bank ratio behind Lots 21, 22 <br />and 23 be 2-to-l, as required by the Subdivision Ordinance, unless <br />the soils report indicates soil instability, in which case the <br />slope bank would be mitigated by a 3-to-1 ratio; (5) that the <br />construction of a retaining wall on Lot 28 be reconsidered with <br />staff at the tentative map stage; (6) that the developer be given <br />some clarifying statements on the project's pro-rata share in the <br />public improvements to the intersection of Dublin Canyon Road and <br />Foothill Road as well as on the improvements to Dublin Canyon Road; <br />and (7) that the retaining wall at the bottom of the property be <br />built of material that would be appropriate with the creek site. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Mohr and Mayor Mercer <br />NOES: Councilmembers Butler and Tarver <br />ABSENT: None <br />ABSTAIN: None <br /> <br /> - 23 - <br /> 11-20-90 <br /> <br /> <br />
