120 <br /> <br /> It was then moved by Mr. Brandes, and seconded by Mr. Butler, <br /> that Resolution No. 90-218 be adopted, based on a review of an <br /> initial environmental impact study done for this project and on a <br /> finding that no significant environmental impact would occur as <br /> outlined in the City's guidelines and on further finding that a <br /> negative declaration is appropriate in connection with <br /> AP-90-15/PUD-90-13, the application of Jeannette Westbrook/S & S <br /> Properties for rezoning from "A" (Agricultural) to the "PUD" <br /> (Planned Unit Development) - Medium Density Residential District <br /> and for development plan approval to construct 40 single-family <br /> residential units on an approximately nine acre site located at <br /> 10890 Dublin Canyon Road. <br /> The roll call vote was as follows: <br /> AYES: Councilmembers Brandes, Butler, Mohr and Mayor Mercer <br /> NOES: Councilmember Tarver <br /> ABSENT: None <br /> ABSTAIN: None <br /> <br /> Ms. Mohr inquired why the PUD proposal does not include the <br /> two pre-existing properties in the area. <br /> <br /> Mr. Swift replied that the application is only for a PUD <br /> development plan. He explained that there would be a parcel map to <br /> split the lot west of the property into two lots, and the second <br /> subdivision into 40 lots after Growth Management approval. He -- <br /> added that the application for rezoning at this time is for ten <br /> acres of the lot. <br /> <br /> Ms. Mohr inquired if Council has the discretion at this time <br /> to include the remainder parcel as part of the PUD. <br /> <br /> Mr. Swift replied that it has not been proposed in that <br /> manner, but Council could initiate a PUD zoning for that parcel as <br /> well. He stated that the remainder of the site is zoned <br /> Agricultural and would stay that way if Council chooses not to <br /> change its zoning. <br /> <br /> Ms. Mohr pointed out that if the remaining five to six acres <br /> should be subdivided at a later time, it would have to be done as <br /> a major modification to the PUD. <br /> <br /> Mr. Swift explained that it would go through the same process. <br /> He said that the property is currently zoned agricultural and would <br /> have to come to Council for rezoning to PUD if it should be <br /> subdivided. <br /> <br /> - 22 - <br /> 11-20-90 <br /> <br /> <br />
