115 <br /> <br /> It was moved by Mr. Mercer, and seconded by Ms. Mohr, that <br />Ordinance No. 1490 be introduced, to be read by title only and <br />waiving further reading thereof, approving PUD-90-7, the <br />application of Jay and Kyoung Ku for Planned Unit Development <br />Rezoning and Development Plan Approval to rezone an approximately <br />1.5 acre site located on the north side of Mohr Avenue immediately <br />westerly of the former Southern Pacific Railroad right-of-way from <br />an "0" (Office) District to a "PUD-C-O" District and to construct <br />a two-story, approximately 48,000 square foot, 70 room senior care <br />facility, as set forth in the Staff Report, subject to the <br />following conditions: (1) that Alternative 2 is approved; (2) that <br />Mohr Avenue be widened; (3) that the soundwall proposed for the <br />back of the property in Alternative 1 be constructed on Mohr Avenue <br />from Kolln Street to the SPRR right-of-way; (4) that maximum <br />occupancy be limited to 70 with every room being a private room; <br />and (5) that resident vehicles be restricted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Butler, Mohr and Mayor Mercer <br />NOES: Councilmembers Brandes and Tarver <br />ABSENT: None <br />ABSTAIN: None <br /> <br /> Mr. Butler commented that public parking on Mohr Avenue should <br />be allowed just like on any other street unless it turns out to be <br />unsafe. <br /> <br /> Mr. Tarver stated that he did not think parking should be <br />allowed on Mohr Avenue because of issues regarding safety, traffic <br />and access into and out of the facility. <br /> <br /> It was moved by Mr. Brandes, and seconded by Mr. Tarver, that <br />parking be prohibited on Mohr Avenue in the area of the facility. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Tarver and Mayor Mercer <br />NOES: Councilmembers Butler and Mohr <br />ABSENT: None <br />ABSTAIN: None <br /> <br /> It was then moved by Mr. Butler, and seconded by Ms. Mohr, <br />that the following Staff Recommendations be approved: (1) No. 5, <br />that the project not be subject to growth management fees, low- <br />income housing fees, park dedication fees, bedroom tax, or other <br />residential fees; (2) No. 6, that the City not be involved in the <br />subsidy of below-market rents for the project; and (3) No. 7, that <br />the applicant not be required to provide below-market rents. <br />The roll call vote was as follows: <br />AYES: Councilmembers Butler, Mohr and Mayor Mercer <br />NOES: Councilmembers Brandes and Tarver <br /> <br /> - 17 - <br /> 11-20-90 <br /> <br /> <br />
