34 <br /> <br /> Mr. Mercer requested Mr. Caudill to meet with Ms. Acosta <br /> regarding his concerns and suggested that he take advantage of the <br /> opportunity to apply for a variance for his fence. <br /> <br /> Mr. Bill McFate, 4715 Augustine Street, resident at the front <br /> house, stated that he built the four-foot fence to keep his <br /> children in his yard. He pointed out that a 30-inch fence would <br /> not protect the children and wanted a solution to the matter if he <br /> is to remove the fence. <br /> <br /> Construction on Railroad Avenue, Division Street and Spring Street <br /> <br /> Ms. Birdie Bianchi, 4329 Railroad Avenue, questioned the <br /> validity of the Minutes since her testimony regarding the postal <br /> service at Railroad Avenue, Division Street and Spring Street was <br /> not reflected therein. She asked who would be responsible for <br /> structural damages and broken windows resulting from the street <br /> construction, as well as the water pipes connecting the meters to <br /> the houses. <br /> <br /> Mr. Mercer explained that the Minutes are a summary of the <br /> Council meeting and that the tapes of the meeting are available to <br /> anyone who wished to listen to them. He referred the matter of <br /> damages to Mr. Roush. <br /> <br /> Mr. Roush stated that a claim for damages could be filed at <br /> the City Attorney's Office. The claim would then be evaluated to <br /> determine if the City should pay for the damages, or the claim <br /> could be referred to the contractor. <br /> <br /> Ms. Bianchi also inquired how wide sidewalks should be to <br /> accommodate wheelchairs. She noted that one of the sidewalks being <br /> constructed measures only 23 inches and two others were 30 inches. <br /> <br /> Mr. Mercer referred the question to Mr. Elliott. <br /> <br /> Mr. Elliott replied that the sidewalks should be at least <br /> three feet for wheelchairs. He added that the sidewalks Ms. <br /> Bianchi referred to were being corrected. <br /> <br /> Ms. Bianchi then stated that Ms. Acosta had given her a call <br /> indicating that there would be no sidewalk in front of Ms. <br /> Bianchi's house, as requested. Ms. Bianchi asked that Ms. Acosta <br /> confirm that approval in writing. <br /> <br /> 10-2-90 <br /> - 6 - <br /> <br /> <br />
