478

Mr. Mercer asked Mr. Roush if the settlement agreement would
be considered at the next Council meeting and if the public would
have access to a copy of the agreement prior to the meeting.

Mr. Roush replied that assuming that the proposed settlement
would be worked out in time, the resolution and proposed settlement
agreement would be part of the Agenda materials for the next
meeting.

Mr. Mercer told Mr. Hatton that he could follow up the matter
with the City Attorney before the next Council meeting.

Mr. James Miller, 3633 Camelot Court, commented that it was
his understanding that Pleasant Village Associates would drop the
suit against the City if the building was allowed to stand. He
inquired why Pleasant Village Associates would be compensated even
after the project was approved.

Mr. Mercer referred the matter to Mr. Roush.

Mr. Roush explained that he preferred to discuss the proposed
settlement when the agreement is in place, during which time the
public will have a better opportunity to comment on it.

Mr. Miller stated that Item 4~ - Settlement of Pleasant
Village Associates vs. City of Pleasanton was omitted from the
Agenda published in The Tri-Valley Herald. He inquired if this was
done intentionally to prevent the Pleasanton Meadows residents from
attending the meeting.

Mr. Mercer replied that the City has no control over what the
newspapers choose to publish.

Ms. Acosta clarified that the City is required to publish its
Public Hearing Notices in the Legal Notices section of the paper
but that the City has nothing to do with the papers' decision to
prin~ Ehe Council Agenda or its synopsis. She added that
individuals concerned are mailed a copy of the Public Hearing
Notice and that a complete copy of the Agenda andAmendments to the
Agenda are posted on the bulletin board at the entrance to City
Hall.

Proposed Road in North Sycamore Area

Mr. Dean Macari, 455 Sycamore Road, presented some slides
showing a proposed alternate street connection that runs through
his property from the Mavridis development. He stated that he had
not seen any map from the City nor did he have any discussion with
City staff regarding this proposed street. He indicated that he
supported the recommendation of the North Sycamore Specific Plan

9-18-90
- 4 -
