493 <br /> <br /> Mr. Butler asked Mr. Swift if there were anything <br />substantially different about the Yees' case that could be <br />addressed by a revision of the Ordinance. <br /> <br /> Mr. Swift explained that the only difference is the Yees' <br />statement that they have no intent to sell the units for ten to <br />twenty years. He agreed with Mr. Butler that the property need not <br />be subdivided until such time that the units are to be sold, in <br />which case the Yees could continue to rent the units at the rate <br />they chose. <br /> <br /> Mr. Tarver commented that since Condition No. 12 would apply <br />to the project whether or not it is included in the Conditions of <br />Approval, he would prefer that the Ordinance be re-introduced at <br />this time and the matter be brought back to Council for further <br />discussion. <br /> <br /> It was moved by Mr. Butler, and seconded by Mr. Tarver, that <br />Ordinance 1484 be re-introduced, to be read by title only and <br />waiving further reading thereof, approving the application of James <br />Yee for planned unit development rezoning and development plan <br />approval of an approximately 14,743 sq. ft. site for four existing <br />single-family residential units located at 991 Rose Avenue, as <br />filed under Case PUD-90-11, subject to the deletion of Condition <br />No. 12 of the Conditions of Approval. <br />The roll call vote was as follows: <br />AYES: Councilmembers Butler, Mohr, Tarver and Mayor Mercer <br />NOES: None <br />ABSENT: Councilmember Brandes <br />ABSTAIN: None <br /> <br />13.
