493 Mr. Butler asked Mr. Swift if there were anything substantially different about the Yees' case that could be addressed by a revision of the Ordinance. Mr. Swift explained that the only difference is the Yees' statement that they have no intent to sell the units for ten to twenty years. He agreed with Mr. Butler that the property need not be subdivided until such time that the units are to be sold, in which case the Yees could continue to rent the units at the rate they chose. Mr. Tarver commented that since Condition No. 12 would apply to the project whether or not it is included in the Conditions of Approval, he would prefer that the Ordinance be re-introduced at this time and the matter be brought back to Council for further discussion. It was moved by Mr. Butler, and seconded by Mr. Tarver, that Ordinance 1484 be re-introduced, to be read by title only and waiving further reading thereof, approving the application of James Yee for planned unit development rezoning and development plan approval of an approximately 14,743 sq. ft. site for four existing single-family residential units located at 991 Rose Avenue, as filed under Case PUD-90-11, subject to the deletion of Condition No. 12 of the Conditions of Approval. It was moved by Ms. Mohr, and seconded by Mr. Tarvet, that Resolution No. 90-177 be adopted, approving the City's participation in the proposed Alameda County low-income housing bond program for seniors, disabled persons, homeless families with children and first-time homebuyers.
