REPORTS OF THE CITY MANAGER Item 12a Ordinance No. 1484, Approvinq the Application of James Yes for Planned Unit Development Rezoninq and Development Plan Approval of an Approximately 14,743 Sq. Ft. Site for Four Existinq Single- Family Residential Units Located at 991 Rose Avenue, as Filed Under Case PUD-90-11 Mr. Peter MacDonald, 400 Main Street, representing James and Anna Yee, stated that the Yees would like to have the flexibility to sell the units in ten to twenty years without being subject to the rent control provisions of the Condominium Conversion Ordinance during that period of time. He pointed out that there was a provision in the Ordinance that allowed the Council to waive the requirement in situations where it would not be applicable. He suggested that Condition No. 12 of the PUD be modified to waive that requirement should the Yees decide to go through the condominium conversion process in the future. He added that they are willing to accept a rent control at a maximum of seven percent annually for two to three years. Mr. Butler commented that it would be impossible for the Council to determine an owner's intentions with regard to whether or not they would eventually sell their projects. 9-18-90 - 17 -
