137

Mr. Tarver commented that he has seen a lot of projects start
with the intention of building affordable units and end up with
none. He inquired if there were any assurance that eliminating the
four affordable units would result in 27 units in the price range
indicated.

Mr. Alborzi replied that it is the intention of the developer
to sell the units to any qualified buyer and that the only factors
that would increase the prices of the units would be an increase in
the cost of materials and labor.

It was moved by Ms. Mohr, and seconded by Mr. Butler, that
Ordinance No. 1502 be adopted, approving the application of Sunwest
Horizon for rezoning and development plan approval for the
construction of 27 two-story townhomes to be located on an
approximately 2.3 acre site generally east of the Old Santa Rita
Road/Santa Rita Road street intersection, as filed under Case
PUD-90-17, with the deletion of Condition No. 38 of the Conditions
of Approval.
The roll call vote was as follows:
AYES: Councilmembers Butler, Mohr, Scribner Tarver and Mayor
Mercer
NOES: None
ABSENT: None
ABSTAIN: None

Item 12i
Adoption of Resolution No. 91-45, Amending Resolution No. 77-133
(Establishing Fees and Charqes for Various Municipal Services of
the City of Pleasanton) to Establish Fees and Charges for Code
Enforcement Actions. (SR 91:111)

Ms. Scribner recommended that the fee schedule include only
the removal fees, without the storage fees, and that whatever is
not picked up by the owner within ten days would be disposed of by
the City.

Mr. Mercer commented that newsracks need to be treated
differently from signs because newsracks are put out by
subcontractors, and newspaper companies would notknow if newsracks
are removed. He added that the newsracks would contain money and
old newspaper and cannot be disposed of in the same way as signs.

Ms. Mohr proposed that the storage fee for newsracks be
retained.

Ms. Scribner inquired how long the City stores newsracks.
Mr. Swift replied that they are kept for 30 days.

- 31 -
4-2-91
