334 <br /> <br /> Art in Public Places Committee <br /> <br /> Mr. Mercer stated that based on the resolution adopted by <br /> Council establishing the policies regarding the Art in Public <br /> Places Committee, the five-member Committee consisting of a <br /> Councilmember, a member of the Pleasanton Cultural Arts Council <br /> (PCAC), and three other members could now be appointed. He added <br /> that he had received four applications and proposed that Mr. Tarver <br /> and the four applicants be appointed to the Committee. <br /> <br /> The Councilmembers agreed. <br /> <br /> Mr. Mercer requested that the item be placed on the Agenda of <br /> the next Council meeting. <br /> <br /> 9. LEGISLATIVE UPDATE REPORTS <br /> There were none. <br /> <br /> Item 12b <br /> Termination of the Contract with MJB Pipeline for the Cross Town <br /> Sanitary Sewer Interceptor (SR 91:278) <br /> <br /> Mr. Bill McInerney, Attorney for MJB Pipeline, voiced his <br /> objections that the termination of the contract was inherently <br /> unfair and an unnecessary action. He stated that Mr. Elliott's <br /> claim that the work must be completed in order to put the line in <br /> use is not supported by facts because the portion of the line in <br /> question could have been put in service as early as January 1991. <br /> He indicated that there had been problems with the pipes involving <br /> solid sheets and Weko-seals, which MJB Pipeline repaired at least <br /> twice at its own cost of about $850,000. He added that MJB <br /> Pipeline has put in about $1 million to finish the project, which <br /> amount excludes the cost of delays and other expenses. He stated <br /> that the City is trying to circumvent a written agreement between <br /> the two parties to postpone the dispute, which would be resolved by <br /> a third party, and to finish the job. <br /> <br /> - 38 - <br /> 7-16-91 <br /> <br /> <br />
