MATTERS CONTINUED FOR DECISION <br /> <br /> Item 10a <br /> Ordinance No. 1531, Application of Kay Ku for Rezoninq and <br /> Development Plan Approval as Filed Under Case PUD-91-02 (Introduced <br /> 11/19/91 - Mercer-No). <br /> <br /> Mr. Peter Shutts, Architect and Designer for the Ku project, <br /> asked to amend certain conditions of the Ordinance as it was <br /> introduced. He then referred to the letter of Ms. Ku in which she <br /> indicated that without some modification to the conditions, she <br /> would withdraw the application. <br /> <br /> Mr. Tarver asked if a limited access easement would reduce <br /> Mrs. Ku's concerns. <br /> <br /> Mr. Shutts responded that it is the presence of the easement <br /> that is the concern and any other wording still leaves it as an <br /> easement. <br /> <br /> Ms. Mohr asked that if the language with respect to an <br /> easement were removed, but the large water fire trucks used for <br /> grass fires had the ability to access the open fields, would he <br /> agree to that? Her concern was not that an easement be dedicated <br /> to the adjoining property but that the access to that open hillside <br /> be retained. <br /> <br /> Mr. Shutts felt that would be acceptable. <br /> <br /> Mr. Butler confirmed with Mr. Shutts that the easement is the <br /> objection, but that access is not. <br /> <br /> Marti Starnes, 5050 Foothill Road, stated the proposed access <br /> goes through to the back of her property and from the very <br /> beginning of this process the access and easement was included as <br /> a condition. She uses this access to bring in livestock to her <br /> property for 4-H projects, weed abatement, etc. and urged Council <br /> <br /> 12/10/91 20 <br /> <br /> <br />
