115 <br /> <br /> It was moved by Mr. Butler, that Council approve the General <br />Plan change and the rezoning and to continue to work with the <br />NPID Committee to define a policy concerning a change in use. The <br />motion died for the lack of a second. <br /> <br /> Ms. Mohr felts that rezoning to retail is a direct reflection <br />of the benefits of the improvements that NPID has paid for and that <br />some participation in the NPID is appropriate. She didn't have <br />enough information at that time to make a judgment as to what the <br />amount should be. Her motion would include directing staff to meet <br />with the NPID Committee and the applicant and bring a <br />recommendation back to Council for setting that fee. She <br />questioned staff if Council could take the first action on the <br />rezoning with that instruction and then when it comes back for the <br />second reading set the dollar amount. <br /> <br /> Mayor Mercer indicated there may not be a zoning request if <br />the fee issue is not settled. <br /> <br /> Mr. Tarver shared the same concern of Ms. Scribner regarding <br />a balance in the zoning. There is also the fairness issue which <br />Council needs to address before it goes forward. <br /> <br /> Mr. Roush recommended that Council defer action on the General <br />Plan and the rezoning pending a decision with respect to the fee <br />issue. <br /> <br /> It was then moved by Ms. Mohr, and seconded by Mr. Tarver, to <br />continue this item to the 1/7/92 City Council Meeting. <br /> <br />The roll call vote was as follows: <br />AYES: Councilmembers Butler, Mohr, Scribner, and Tarver. <br />NOES: Mayor Mercer <br />ABSENT: None <br />ABSTAIN: None <br /> <br />Item 6b <br />PUD-91-2, Kay Ku <br />Application for Planned Unit Development rezoninq and development <br />plan approval for a three lot custom home subdivision on the west <br />side of Foothill Road located at 5130 Foothill Road. The subject <br />property is located within the West Foothill Road Corridor Overlay <br />District. Zoninq for the property is "A" (Aqricultural) District. <br />(SR91:470) <br /> <br /> Mr. Mercer declared the public hearing open on the <br />application. <br /> <br /> Mr. Peter Shutts, 4133 Mohr Avenue, Suite G, Pleasanton, <br />appeared as architect and representative for the Ku's. <br /> <br />11/19/91 <br /> <br /> <br />
