114 <br /> <br /> the Committee disagree and that issue is the most difficult to <br /> resolve. <br /> <br /> There being no further testimony, Mr. Mercer declared the <br /> public hearing closed. <br /> <br /> Ms. Scribner stated that she is concerned with rezoning and <br /> allowing retail in this area. There are already a number of retail <br /> spaces vacant. Council has an obligation to control where retail is <br /> placed. She would like to establish a policy so that Council <br /> doesn't continue making these decisions case-by-case. <br /> <br /> Mayor Mercer asked staff how it came up with $40,00 for the <br /> gas station. <br /> <br /> Mr. Swift replied that the intersection at Hopyard and Owens <br /> had to be rebuilt. The traffic study calculated the increase in <br /> traffic caused by the gas station and applied that number to the <br /> reasonable cost of what it would take to improve that particular <br /> intersection. The amount didn't have a direct correlation to what <br /> that site would have paid had it been in the NPID, but the <br /> improvement of that intersection was part of the NPID funded <br /> projects. The gas station contribution, therefore, went directly to <br /> offsetting the cost to NPID. <br /> <br /> Mr. Butler indicated he did not see a problem in the rezoning <br /> and felt this is a reasonable request for the area. However, that <br /> is a separate issue from the NPID fee. He stated that staff and <br /> the NPID Committee need to work out a policy. From the staff <br /> report, it appears all issues have been worked out except two. He <br /> concluded the rezoning and change of the interior of the building <br /> without an increase of square footage should not generate a new <br /> fee. <br /> <br /> It was moved by Mr. Butler, and seconded by Ms. Mohr, that <br /> Resolution No. 91-191 be adopted, based on a review of an initial <br /> environmental impact study done for this project and on a finding <br /> that no significant environmental impacts would occur as outlined <br /> in the City's Guidelines and on further finding that a negative <br /> declaration is appropriate in connection with Case No. AP-91-9 <br /> (GP-91-6/PUD 91-7). <br /> <br /> The roll call vote was as follows: <br /> AYES: Councilmembers Butler, Mohr, Scribner, Tarver, Mayor <br /> Mercer <br /> NOES: None <br /> ABSENT: None <br /> ABSTAIN: None <br /> <br /> ~/19/91 <br /> 6 <br /> <br /> <br />
