¸67 <br /> <br /> One of the parties involved in this matter came forward to <br />protest as he didn't believe that the Council had the authority to <br />take action at this time. The Brown Act specifies that any time an <br />item is agendized that would result in action must be conspicuously <br />posted 72 hours in advance of the meeting. This gentlemen said he <br />had received a phone call at 2:45 today and has had no opportunity <br />to review any of the materials the City has. He then requested <br />that the matter not be placed on tonight's agenda but be continued. <br /> <br /> Mr. Mercer responded that 4/5 of the Council has to vote to <br />get an item onto the agenda after the agenda is posted. The motion <br />and vote that was just taken places that item on the agenda. At <br />the time this issue is dealt with the speaker can then request <br />continuation. <br /> <br />4. CONSENT CALENDAR <br /> <br /> Peggy Purnell, 2472 Via De Los Melagros, requested that Item <br />4A under the Consent Calendar be removed so that the minutes can be <br />amended. At the last City Council Meeting on October 1, 1991 <br />Rebecca Dennis submitted a letter that expressed concerns about a <br />possible conflict of interest involving Chris Meidl serving as the <br />chairperson and public spokesperson for the Parks and Recreation <br />Subcommittee while being employed by the law firm that represents <br />Amador Land and Cattle. Ms. Dennis also read other letters that <br />voiced objections to Mr. Meidl. Ms. Purnell requested that the <br />names, addresses and objections of these other parties be made part <br />of the minutes. The Council agreed that the minutes should be <br />amended to so reflect. <br /> <br /> Councilmember Scribner requested the minutes be amended at <br />page 8 to indicate in detail what the adopted staff recommendation <br />was. She further indicated that motions in future minutes should <br />set out the specific Council action not just a reference to staff <br />recommendation. She felt that anyone reading minutes should be <br />able to determine what Council action was without having to refer <br />to a staff report. <br /> <br /> Mr. Robert Cordtz, 262 W. Angela, requested that Item 4H be <br />removed from the Consent Calendar in order that it be discussed in <br />greater detail. After reviewing the proposal concerning the <br />awarding of the contract and joint venture agreement with DSRSD for <br />a new City well, he wanted a number of comments of his to be <br />addressed. <br /> <br /> Mayor Mercer asked Mr. Elliott if it was urgent that this <br />issue be passed tonight or could it be continued. <br /> <br /> Mr. Elliott responded that it is rather important that this be <br />moved upon as quickly as possible, but that he would be willing to <br />respond to all of Mr. Cordtz's questions. <br /> <br />10-15-91 3 <br /> <br /> <br />
