COMMUNICATIONS <br /> <br />Presentation Reaardin~ Regulation of Horses <br /> <br /> Mr. Johnny King stated that according to state law, the <br />regulation of streets and highways and traffic thereon is the <br />exclusive jurisdiction of the state, and local regulation of these <br />matters is allowed only where explicitly provided in the Vehicle <br />Code. He continued that in order for cities to regulate horse <br />traffic, State Law must say so, and nowhere in the statute is the <br />regulation of horse traffic authorized. He presented various cases <br />which support the rights of people who travel the public streets <br />and highways of the City of Pleasanton by foot, horse and bicycle. <br />He contended they do not do so at the pleasure and discretion of <br />City officials. They do so by rights firmly established and <br />protected by state and federal laws. <br /> <br /> Mr. King stated that The Robert C. Philcox Memorial Horse <br />Traffic Ordinance is unlawful, invalid, and unenforceable. He <br />demanded that the Council rescind and repeal the ordinance and <br />order that all signs posted on city streets prohibiting horses or <br />bicycles or pedestrians be immediately removed. <br /> <br />10-01-91 17 <br /> <br /> <br />
