160 <br /> <br /> 11. LEGISLATIVE UPDATE REPORTS <br /> <br /> Item 11a <br /> R~ 531 (Land Use Requlations) <br /> <br /> Mark Stivers, ECHO Housing, Hayward, spoke in favor of this <br /> item. He explained that as advocates of fair housing, they see <br /> this as a positive bill for providing equal opportunities for fair <br /> housing. He inquired why Council was opposing this bill. <br /> <br /> Mr. Roush responded the primary reason that staff had chosen <br /> to oppose this legislation was because it would result in the City <br /> not being able to treat commercial daycare centers differently than <br /> residential daycare facilities. This legislation would rule out <br /> requirements such as a use permit for facilities with six or more <br /> children. <br /> <br /> Mr. Stivers explained that his primary concern was that equal <br /> opportunities for housing for the disabled was being provided. <br /> <br /> Mayor Mercer asked that this item be continued to a further <br /> City Council meeting for further discussion. <br /> <br /> Ms. Mohr asked staff to explain at that time the difference <br /> between SB1234 and AB351 and inquired if the Ku Senior Care project <br /> was covered by this legislation. <br /> <br /> Item 11b <br /> O~position to ~R 2067 (Floyd) Police Officers Bill of Riahts <br /> <br /> It was moved by Mr. Butler, and seconded by Ms. Scribner, that <br /> Resolution No. 92-63 be adopted, opposing Assembly Bill 2067 <br /> (Floyd), Police Officers Bill of Rights. <br /> <br /> The roll call vote was as follows: <br /> AYES: Councilmembers Butler, Mohr, Scribner, Tarver and Mayor <br /> Mercer <br /> NOES: None <br /> ABSENT: None <br /> ABSTAIN: None <br /> <br /> Item llc <br /> Review of AB 2307 (Baker) Detachment of Territorv <br /> <br /> Gino Tolari, 9550 Santos Ranch Road, represented the property <br /> owners in this area who were in favor of this bill. He felt the <br /> property owners should have an equal say in determining to what <br /> City they will be annexed. The City of Hayward has refused to de- <br /> annex this property.
