97 <br /> <br /> Mayor Mercer agreed with Mr. Tarver in that the Council's <br />original decision should not be changed. He felt that there could <br />be another location for this facility and therefore, he did not <br />support the modification. <br /> <br /> Ms. Scribner felt that there was a great need for this type of <br />project. She did not support the modification because she felt the <br />decision to limit the facility to 70 occupants was made in good <br />faith between the developer and the City Council. <br /> <br /> It was moved by Mr. Butler, and seconded by Ms. Mohr to modify <br />a condition of approval of an existing PUDlimiting occupancy to 70 <br />persons to permit a maximum occupancy of 90 persons for an approved <br />senior care facility proposed to be located at 4115 Mohr Avenue. <br /> <br />The roll call vote was as follows: <br />AYES: Councilmembers Butler, and Mohr <br />NOES: Councilmembers Scribner, Tarver and Mayor Mercer <br />ABSENT: None <br />ABSTAIN: None <br /> <br /> It was moved by Ms. Scribner, and seconded by Mr. Tarver, to <br />deny PUD-90-7-1M, the application to modify a condition of approval <br />of an existing PUD limiting occupancy to 70 persons to permit a <br />maximum occupancy of 90 persons for an approved senior care <br />facility, proposed to be located at 4115 Mohr Avenue. <br /> <br />The roll call vote was as follows: <br />AYES: Councilmembers Scribner, Tarver and Mayor Mercer <br />NOES: Councilmembers Butler, and Mohr <br />ABSENT: None <br />ABSTAIN: None <br /> <br />7.
