97 Mayor Mercer agreed with Mr. Tarver in that the Council's original decision should not be changed. He felt that there could be another location for this facility and therefore, he did not support the modification. Ms. Scribner felt that there was a great need for this type of project. She did not support the modification because she felt the decision to limit the facility to 70 occupants was made in good faith between the developer and the City Council. It was moved by Mr. Butler, and seconded by Ms. Mohr to modify a condition of approval of an existing PUDlimiting occupancy to 70 persons to permit a maximum occupancy of 90 persons for an approved senior care facility proposed to be located at 4115 Mohr Avenue. The roll call vote was as follows: AYES: Councilmembers Butler, and Mohr NOES: Councilmembers Scribner, Tarver and Mayor Mercer ABSENT: None ABSTAIN: None It was moved by Ms. Scribner, and seconded by Mr. Tarver, to deny PUD-90-7-1M, the application to modify a condition of approval of an existing PUD limiting occupancy to 70 persons to permit a maximum occupancy of 90 persons for an approved senior care facility, proposed to be located at 4115 Mohr Avenue.
