52 <br /> <br /> He continued that staff recommended Council eliminate the <br /> condition that there not be occupancy until the public improvements <br /> were accepted. Staff felt that there would be utilities to the <br /> sites and the other public improvements should be completed by the <br /> time of occupancy. If the public improvements were not <br /> substantially complete, there would be enough water pressure to <br /> serve the project and to provide fire protection. <br /> <br /> Mr. Elliott confirmed that all roads for lots 1 to 46 were <br /> paved and that most of the utilities had been installed. The <br /> infrastructure for the first 46 lots is complete. The road leading <br /> to the staging area and the staging area are considered part of the <br /> public improvements. <br /> <br /> Ms. Acosta stated that staff's recommendation was to include <br /> all other public improvements ($26,000), not for only the security <br /> for utilities ($10,000). <br /> <br /> Mr. Roush stated that the $26,000 represents the proportionate <br /> share of the 46 lots for the public improvements that still need to <br /> be done. As work continues and other public improvements are <br /> complete, that $26,000 figure will be reduced. <br /> <br /> Ms. Scribner asked how it was planned to get the fees <br /> collected. <br /> <br /> Mr. Roush stated that if the lots continue to close, then the <br /> close of the next three to four lots should give the City $1.2 <br /> million so that the public improvements will be completed for the <br /> 46 lots. If they do not close, the property owners would be <br /> required to pay $20-$25,000. <br /> <br /> Ms. Mohr supported the staff recommendation. She felt that it <br /> should be made possible for those property owners to get financing. <br /> <br /> It was moved by Ms. Mohr, and seconded by Ms. Scribner, <br /> approving the issuance of building permits and certificates of <br /> occupancy to the property owners of Golden Eagle Farms, Tract 6033, <br /> subject to the following conditions, a written agreement by a <br /> property owner who wants a building permit that such owner will not <br /> protest the formation of an assessment district to construct the <br /> public improvements should that become necessary; and a letter of <br /> credit, or other security, to be provided by the property owner <br /> prior to occupancy for that owner's share of uncompleted public <br /> improvements. <br /> <br /> The roll call vote was as follows: <br /> AYES: Councilmembers Mohr, Scribner, and Tarver <br /> NOES: None <br /> ABSENT: Councilmember Butler <br /> ABSTAIN: Mayor Mercer <br /> <br /> 1/21/92 <br /> 20 <br /> <br /> <br />
