REPORTS OF THE CITY MANAGER <br /> <br /> Item 12a <br />A~ameda County General Plan Update Environmental Impact RepOrt <br />Notice of Preparation (IR92:59) <br /> <br /> No action was required or taken by the Council on this item. <br /> <br /> Item 12b <br /> Item 4f <br />Resolution Desianatina Alameda Conqestion Manaaement AqencV (CNA) <br />as the Overall Proqram Manaqer for Alameda County Pursuant to <br />AB434, Health and Safety Code, Section 44241(e) (SR92:337) <br /> <br /> Mayor Mercer indicated that the Alameda Congestion Management <br />Agency was a very unorganized Agency and believed that Council <br />should not designate it as the Overall Program Manager until the <br />voting structure is changed. He explained that the voting <br />structure was changed once before. The City of Oakland is not a <br />part of the JPA nor had it voted to be part of the JPA, but Oakland <br />was the moving force to change the voting under the Joint Powers <br />Agreement. This resulted in giving the five largest cities (three <br />in the northern part of the County) control over the CMA. As it is <br />now, all of the City of Pleasanton's changes to the General Plan <br />would have to be approved by the CMA. Mayor Mercer believed that <br />the CMA will soon become the new transportation agency for the <br />County. The voting structure was never changed back. Wheels lost <br />a seat in the voting structure so it may sue CMA. He felt that <br />Council should not approve this but that a letter be sent <br />explaining that Council would consider this matter after the voting <br />structure is changed. <br /> <br /> Mr. Butler asked if the funds would be lost if Council chose <br />not to approve this. <br /> <br /> Mayor Mercer did not believe so. <br /> <br /> Ms. Acosta stated the Mayor's recommendation would not have a <br />financial impact. She felt that CMA would get enough cities and <br />the County to vote for this item to carry it forward. <br /> <br /> Mayor Mercer requested a letter also be sent to each Mayor to <br />explain why the City of Pleasanton did not approve this. He <br />indicated that the voting structure would be discussed at the next <br />Mayor's Conference in September. <br /> <br /> Mr. Butler agreed.
