190 <br /> <br /> Christopher Schleis, Attorney at Law, represented Jerry Wagner <br /> the Park owners, felt that tenants and their representatives had <br /> exaggerated the situation. He stated that Mr. Wagner owned 29 of <br /> the lowest rent spaces in the City. He had presented Council with <br /> a study that was completed by Mr. Wagner in July 1992. This study <br /> concluded that Mr. Wagner's Park is superior to Fairview Park. He <br /> presented the qualifications of Mr. Mohney, the real estate broker <br /> who conducted the study. Fairview park has 50-60% higher rents <br /> than Pleasanton Mobile Home Park. <br /> <br /> Mr. Schleis believed that Council should not conduct another <br /> study and spend $5000 at this time. Four months ago, he spoke with <br /> Mr. Roush and also suggested that a study be conducted, much like <br /> the one Mr. Wagner commissioned by a real estate broker qualified <br /> in mobile home park sales. Three months ago, he appeared at a <br /> Pleasanton Mobile Home Park hearing and suggested that a study be <br /> conducted. Mr. Schleis explained that the intention was not to <br /> raise the rents and run people cut on the street or do any harm as <br /> suggested by the previous speakers. Mr. Wagner wants to be treated <br /> fairly. The problem is simple. He and Mr. Wagner had made a <br /> proposal and had not received a meaningful response from the tenant <br /> representatives. He explained that whenMr. Wagner purchased this <br /> property he spoke withMr. Roush andMr. Heckathorn, who led him to <br /> believe that it was possible to have a gradual increase of rents at <br /> Pleasanton Mobile Home Park, so they would be commensurate with the <br /> bench mark that was established by the Agreement. He suggested <br /> that Council hear the testimony of his appraiser and get a report <br /> of the status of negotiations. <br /> <br /> Mayor Mercer asked why Mr. Wagner would not sign the new <br /> Agreement. <br /> <br /> Mr. Schleis stated that the new Agreement fixes rents at 60% <br /> of what the rents were at comparable or less comparable properties. <br /> It did not give Mr. Wagner equal treatment. <br /> <br /> Jim Richards, representing 150 of the mobile home units in <br /> Hacienda Mobile Home Park, stated as follows: He serves as the <br /> president of the Vintage Villa Homeowners Association. He believed <br /> that the reports of the negotiations in the GSMOL "Californian" and <br /> Mr. Burton's version in the "Hacker" contained numerous <br /> inaccuracies and falsehoods. He stated that he and Audra Rager, <br /> President of Vineyard Villa Homeowners, have been serving as <br /> trustee for the residents of Pleasanton Mobile Home Park, pending <br /> selection of a park spokesperson. They recommended to Council in <br /> March that the proposed ordinance for Pleasanton Mobile Home Park <br /> be tabled for further study because the ordinance, as written, <br /> would have resulted in rental rates at Pleasanton Mobile Home Park <br /> higher than those at Fairview, Vineyard Villa and Hacienda, that <br /> latter two parks being five star parks <br /> <br /> 8/18/92 12 <br /> <br /> <br />
