124 <br /> <br /> Lupe Szymanski, 2790 Longspur Way, agreed that the area in the <br /> back of the center should be monitored more closely. <br /> <br /> Mark Seagel, Centers Business Management, stated that the <br /> problem was enforcement and not the opening or closing of the <br /> fence. He explained that a lot of the tenants were having <br /> financial difficulties. He believed that the loitering and <br /> disturbance would be eliminated if this area were lit up with <br /> active open businesses rather than chained off. The management of <br /> the center had recorded an increase in burglary activity and he <br /> attributes this to the area being chained off. <br /> <br /> Mr. Gade stated that customers from the physical fitness <br /> business had been known to stand outside after classes and <br /> converse. He agreed that it was the management's responsibility to <br /> enforce the conditions of the center but felt that the residents <br /> should not have to rely on the police to enforce the problems that <br /> would be created by opening the back area. <br /> <br /> Kathy Johnson, owner of No Sweat Fitness, explained that she <br /> did not object to having the chain there but asked if it were <br /> possible to leave it open until 9:30-10:00 p.m. Her business <br /> closes at that time. She indicated that the only problems that <br /> she had observed in the center was the skateboarders. She <br /> presently leaves her business at approximately 9:30 p.m. and was <br /> not aware of any noise disturbance of any sort. <br /> <br /> Joanne Gate pointed out that if the fence were closed after <br /> 10:00 p.m. those cars parked in that area before that would be <br /> locked in. <br /> <br /> Marsha Classen explained that the management of the center <br /> would continue to work with the Poppy Lounge regarding the noise <br /> levels and then she proposed that the gate remain open until 9:30 <br /> p.m.. She said that they would hire a person to close the gate at <br /> that time. She also stated that she would place parking signs in <br /> that area for any potential customers which would indicate that the <br /> area would be closed after a certain time. <br /> <br /> There being no further testimony, Mr. Mercer declared the <br /> public hearing closed. <br /> <br /> Ms. Mohr referred to the chain being locked at 7:30 p.m. and <br /> asked if the businesses would have to close at that time. <br /> <br /> Mr. Swift answered that the businesses did not have to close <br /> at 7:30 p.m. It was only the gate that closes. He pointed out <br /> that the building was originally intended for office use only. <br /> <br /> Ms. Mohr asked what the record was for police contact and <br /> calls. <br /> <br /> 7/7/92 6 <br /> <br /> <br />
