24

problem. She felt that this was an opportunity to receive
information and give it to the public and educate ~he voters. The
timing was bad but it was necessary to explore alternatives and
options.

Mr. Tarver moved, and Ms. Scribner seconded, that Pleasanton
enter into discussions about settlement, to find out what the
conditions could be and whether or not it could work, but that no
action be taken until after the election.

The rQ~ ~all vote was as fol~QWs:
AYES: CouncilmAm~ers Scribner and Tarver
NOES: Mayor Mercer, Councilmembers Butler and Mohr
ABSENT: None
ABSTAIN: None

Mayor Mercer felt that the election was being tainted because
Pleasanton is in the middle of a process. He did not object to
considering this after the election in June. He believed that the
Greenbelt Alliance should not be a pan of the negotiations. Just
because it filed suit should not give it the authority to
negotiate. He would rather East Bay Regional Park District-be
involved. He did not feel that Pleasanton residents should pay the
legal fees for the Greenbelt Alliance.

Ms. Mohrdid not agree that Measure. M was placed on the ballet
not in good faith. If Measure K was supported by the voters and
Council entered into negotiations, then Council would have entered
inthe negotiations other than in good faith. She was disconcerted
about the comments made this evening which seemed to be clear
threats. She felt that there was an obligation to the voters to
follow through. She would be willing to look at alternatives if
Measure K failed.

Mr. Butler stated that this proposal was not about open space
and Measure K, it was to discuss a lawsuit. He was willing to
discuss any arrangement that helped Council further the objective
of open space but if the settlement proposal was legitimate, it
would not have come at this time. He agreed that the Greenbelt
Alliance should not be part of the negotiations. The negotiations
would derail the process of this election if entered into at this
time. Measure K was a mandate to a process. The citizens need to
decide on Measure K.

Item 8c
Street Maintenance

Mr. Butler requested a review of street maintenance at Las
Lomitas/Oak Circle/Entrada (Pleasanton Heights area).

5/5/92 24
