19 <br /> <br />-- Herb Garms, 1344 So. Riverview, Gardnerville, Nevada, <br /> explained that the spring, at one time, furnished his whole ranch <br /> along with the house and garden. He did not understand why Mr. <br /> Glenn was concerned about this spring because it provided a large <br /> amount of water and there were several other creeks. He was in <br /> support of the lot line adjustment. He explained the history of <br /> the properties. <br /> <br /> Mannie Joel, 5470 Foothill Road, commended City staff for <br /> doing a thorough job on the boundary adjustments. He referred to <br /> the staff report and asked that. the following changes be made: Page <br /> one, change "neighbors"' to "neighbor" because Mr. Glenn was the <br /> only one who objected to this; Page two, No. 6, clarify that this <br /> area is steep terrain which is covered bypoison oak. He indicated <br /> that there were several springs in this area and therefore, there <br /> would not be a problem of water shortage for the animals. He asked <br /> thatMr. Neu be added to the list of adjacent neighbors who usethe <br /> roadway. He stated that Mr. Glenn is not an adjacent neighbor <br /> because this proper~y did not touch or join Mr. Glenn's proper~y. <br /> Page three, third line, add Mr. Frank Neu's name. He 'agreed with <br /> the staff recommendations. <br /> <br /> Mayor Mercer referred to the staff repor~ which included a <br /> paragraph stating that Mr. Joel had not imposed or intended on <br /> making any modifications that would be detrimental to the springs <br /> and asked if this was ~rue. <br /> <br /> Mr. Joel answered yes. <br /> <br /> Mr. Tarver asked if Mr. Joel planned on using the spring for <br /> any other use other than letting it remain. He asked. what was the <br /> condition in the Garms PUD as to the spring. <br /> <br /> Mr. Joel stated that he would not do anything to the spring <br /> that would be to the detriment of wild animals. <br /> <br /> Mr. Swift stated that the PUD reads that this area is open <br /> space and does not speak to the stream or creek. The EIR did not <br /> apply to this creek because there was no.proposed change to it. <br /> Mr. Glenn was referring to the EIR which applied to the stream to <br /> the south border of the Garms Ranch. He pointed out that any <br /> significant changes to the creek that Mr. Joel wanted to do would <br /> come back to Council for approval. <br /> <br /> Mr. Butler asked Dr. Joel if he understood. that the <br /> requirements of the PUDwould apply to this property after the lot <br /> line adjustment. <br /> <br />_ Dr. Joel stated yes, and that he would be discussing the <br /> spring with staff at a later date. <br /> <br /> 5/5/92 19 <br /> <br /> <br />
