19 -- Herb Garms, 1344 So. Riverview, Gardnerville, Nevada, explained that the spring, at one time, furnished his whole ranch along with the house and garden. He did not understand why Mr. Glenn was concerned about this spring because it provided a large amount of water and there were several other creeks. He was in support of the lot line adjustment. He explained the history of the properties. Mannie Joel, 5470 Foothill Road, commended City staff for doing a thorough job on the boundary adjustments. He referred to the staff report and asked that. the following changes be made: Page one, change "neighbors"' to "neighbor" because Mr. Glenn was the only one who objected to this; Page two, No. 6, clarify that this area is steep terrain which is covered bypoison oak. He indicated that there were several springs in this area and therefore, there would not be a problem of water shortage for the animals. He asked thatMr. Neu be added to the list of adjacent neighbors who usethe roadway. He stated that Mr. Glenn is not an adjacent neighbor because this proper~y did not touch or join Mr. Glenn's proper~y. Page three, third line, add Mr. Frank Neu's name. He 'agreed with the staff recommendations. Mayor Mercer referred to the staff repor~ which included a paragraph stating that Mr. Joel had not imposed or intended on making any modifications that would be detrimental to the springs and asked if this was ~rue. Mr. Joel answered yes. Mr. Tarver asked if Mr. Joel planned on using the spring for any other use other than letting it remain. He asked. what was the condition in the Garms PUD as to the spring. Mr. Joel stated that he would not do anything to the spring that would be to the detriment of wild animals. Mr. Swift stated that the PUD reads that this area is open space and does not speak to the stream or creek. The EIR did not apply to this creek because there was no.proposed change to it. Mr. Glenn was referring to the EIR which applied to the stream to the south border of the Garms Ranch. He pointed out that any significant changes to the creek that Mr. Joel wanted to do would come back to Council for approval. Mr. Butler asked Dr. Joel if he understood. that the requirements of the PUDwould apply to this property after the lot line adjustment. _ Dr. Joel stated yes, and that he would be discussing the spring with staff at a later date. 5/5/92 19
