18

Mr. Tarver stated that he originally supported the waiver of
the fees for the moderated income properties. He now objected to
using affordable housing fees to assist moderate income projects
because money is taken from other much needed projects. He agreed
with Mr. Swift's comments.

It was moved by Mr. Butler, and seconded by Mr. Tarvet, to
deny the request for a waiver of the affordable housing and other
fees for allunits in the Palemine Place townhouse project located
at 600 Palemine Drive (northeast corner of Bernal Avenue and
Palemine Drive). PUD-90-10, Joseph Callaban.

The roll call vote was as follows:
AYES: Councilmembers Butler, Mohr, Scribner, Tarver and Mayor
Mercer
NOES: None
ABSENT: None
ABSTAIN: None

8. MATTERS INITIATED BY COUNCILMEMBERS

Item 8a
LLA-92-2, Mannie Joel and Mart~a Greist/A-M Homes
Review of an ammlication for a lot line adjustment to transfe;
approximately 3.9 acre parcel ~0m the 12~ acre parcel owned bV-A-M
Homes to the 57 acre parcel owned bv M. Joel/M. Greist located
5470 Foothill Road. Zoninq for the property is PUD (Planned
Development) - Low Densit7 Residential District. (SR92:195)

David Glenn, 5650 Foothill Road, spoke on behalf of the
Preserve Area Ridgeland Committee. He referred to a memo dated
April 16, 1992 to the Planning staff and the staff report of
May 5, 1992 and read excerpts from these materials. Mr. Glenn
expressed his concern about preserving the spring in this area
because it served wild animals. He also referred to the EIR and
felt that this lot line adjustment was violating it. He understood
that the applicant and current resident had no plans in eliminating
this spring but he was concerned that future residents would not do
the same.

Mr. Tarver asked if the spring would be part of the PUD after
the lot line adjustment. He also asked if it was possible that
Council could place conditions on property that was not in the PUD.

Mr. Swift clarified that the PUD zoning does not change by the
lot line adjustment. The ownership of the property would be the
only change. If Council wished to attach any conditions that were
not related to what the subdivision map allowed under a lot line
adjustment, staff would then recommend Option 2.

5/5/92
