250

Ms. Mohr felt that clarification of language is not
substantial and findings could not be made that this final map is
out of compliance.

Mr. Roush stated that if the Council majority felt that it is
appropriate to add the clarifying language to the CC&R's, staff
would do so because the changes are consistent with the conditions
of approval.

It was moved by Mr. Pico, and seconded by Ms. Mohr, that
Sections 1.3, 1.5, 12.1.2 of the CC&R's be amended to add the word
"earthquakes" in Section 1.3 and 1.5 and that the specific lots
affected by the fault zone setback be identified in Section 12.1.2.

The roll call vote was as follows:
AYES: Councilmembers Mohr, Pico, Scribner and Mayor Tarver
NOES: None
ABSENT: None
ABSTAIN: None

~1- LEGISLATIVE UPDATE REPORTS

There were none.

~2- REPORTS OF THE CITY MANAGER

Item 12a
Approval of Resolution Establishinq the City Economic Development
~dvisory Committee (SR92:513)

Ms. Acosta presented the staff report.

Ms. Mohr suggested that a time be set for the annual meeting.

Mr. Pico asked if the policies require that the members of
this Committee be residents of the City of Pleasanton. If this was
not a requirement, he felt it would be appropriate to make that a
requirement. He was also concerned with the make-up of the
Committee. A number of his concerns would be mitigated if all of
the members of the Committee are residents. He felt that the
"Citizen at Large" should be a citizen of Pleasanton as well. He
believed that the environmental and educational sectors are being
ignored. He wanted more flexibility on the membership of the
Committee.

Ms. Scribner stated that normally she would agree that citizen
participation is important and that the members should be citizens
of the City. However, in this case she felt that the Committee is
looking towards the economic viability of the City and a lot of
people who make or bring in money do not live in Pleasanton.
