180 <br /> <br /> Mr. Swift explained that the conditions listed in Exhibit B <br /> relate to a modified plan that would take all of the houses off of <br /> the hill. Condition 9 refers to the supplemental environmental <br /> impact report to address those areas that the EIR said would be <br /> affected by the remedial grading. <br /> <br /> Jerry Dommer, 256 Sutter Street, San Francisco, Dommer & Byers <br /> Architects, explained that this project has been in process for <br /> approximately six years. It has come a long way in this process <br /> and finds itself in a gridlock of opinion between the City's <br /> consulting geologist and' the development's project geology team. <br /> The recent Planning Commission approval of 37 lots removed 17 lots, <br /> which are the nicest lots of this development. He introduced Mr. <br /> Makdessi who would explain how their team of geologists concluded <br /> that the ancient landslide was stable. <br /> <br /> Simon Makdessi, 4384 Indigo Drive, San Jose, Terrasearch, <br /> explained that between 1986 and 1990 there has been a number of <br /> investigations on the geological aspects of this project. In 1990 <br /> a consensus was reached among all of the geologists regarding <br /> certain geological landslide mechanisms of the project. The <br /> ancient landslide is at least 40,000 years in age. In 1992 there <br /> was additional investigation work which determined the stability of <br /> this landslide. He explained the types of tests and investigations <br /> carried out to make the conclusion that this ancient landslide is <br /> stable. Mr. Makdessi pointed out that the staff report indicated <br /> that the landslide had the potential to move 2 feet under <br /> earthquake conditions. He stated that there was no information as <br /> to where this conclusion had originated. Mr. Makdessi concluded <br /> that the applicant had gone out of his way to determine that this <br /> landslide was stable. <br /> <br /> Dr. Robert Pyke, 1076 Carol Lane #136, Lafayette, Registered <br /> Civil and Geotechnical Engineer, reviewed the Terrasearch report <br /> dated August 4 and October 12 and did not fully agree with the <br /> report dated August 4. He supported the opinion of the City's <br /> reviewing geologist that there were sufficient uncertainties in the <br /> calculations that had been done and believed it appropriate to do <br /> additional studies. The conclusions are not only the function of <br /> calculations, but are also functions of observations over a period <br /> of time as to the geologic history of the site. The calculations <br /> always introduce some element of uncertainty. There is an ancient <br /> landslide that moved down the slope and is presently stable. He <br /> concurred with the findings listed in the October 12 report. He <br /> did believe that this landslide is stable. He believed that there <br /> was no technical reasons produced to counter the conclusions of <br /> Terrasearch's October 12, 1992 report and no technical reasons why <br /> Council should not approve the 55-1ot development. <br /> <br /> Jerry Dommer concluded by asking for approval of the 55-1ot <br /> project. He asked that in the event that Council voted to approve <br /> the 37-1ot project that Council not place lots B and C into a <br /> <br /> 11/17/92 6 <br /> <br /> <br />
