Mayor Mercer asked when this item was coming back to Council.

Mr. Roush stated that it would not be by October 1, but more
likely the first meeting in November. He preferred to continue to
work with Mr. Wagner to work out an agreement with the City. He
explained that an ordinance would take this long to put together
because information needed to be gathered before a staff report
could be written.

Mr. Wagner reiterated that he wanted to expedite this matter.

Mayor Mercer stated that at the last City Council meeting the
Council decided to refer this item back to the City Attorney for a
possible ordinance. What Mr. Roush was trying to indicate is that
it was possible for Mr. Wagner to negotiate an agreement anytime.
If he chose not to do that, then the item would come back to
Council in November.

Mr. Butler stated that he preferred to see an agreement as
well.

§. He felt that they
had come to a reasonable agreement. He agreed that this issue
should not be one that the City should address but he was before
Council this evening to ask that Council allow him to reach an
agreement with Ms. Sorenson. Mr. Joel pointed out some historical
uses of this water and asked for modifications to the proposed
conditions. This spring is 1/4 mile from Ms. Sorenson's. This
spring had been used intensively by the Garms Ranch for household
and ranch use. He referred to the staff report and stated he did
not believe that Ms. Sorenson was losing water when he used his
water system. He stated that staff has never tested her well and
no other testing had been done. He had inspected Ms. Sorenson's
water tank and found moss and calcium, which indicates that the

9/1/92 6
