Mayor Mercer asked when this item was coming back to Council. <br /> <br /> Mr. Roush stated that it would not be by October 1, but more <br /> likely the first meeting in November. He preferred to continue to <br /> work with Mr. Wagner to work out an agreement with the City. He <br /> explained that an ordinance would take this long to put together <br /> because information needed to be gathered before a staff report <br /> could be written. <br /> <br /> Mr. Wagner reiterated that he wanted to expedite this matter. <br /> <br /> Mayor Mercer stated that at the last City Council meeting the <br /> Council decided to refer this item back to the City Attorney for a <br /> possible ordinance. He felt that they <br />had come to a reasonable agreement. He agreed that this issue <br />should not be one that the City should address but he was before <br />Council this evening to ask that Council allow him to reach an <br />agreement with Ms. Sorenson. Mr. Joel pointed out some historical <br />uses of this water and asked for modifications to the proposed <br />conditions. This spring is 1/4 mile from Ms. Sorenson's. This <br />spring had been used intensively by the Garms Ranch for household <br />and ranch use. He referred to the staff report and stated he did <br />not believe that Ms. Sorenson was losing water when he used his <br />water system. He stated that staff has never tested her well and <br />no other testing had been done.
