Livermore, the City of Pleasanton or the County of Alameda.

4. The FranchBe A~eement Creates a quasi-public utility with unremxlated
rates.
The toils are proposed to be 12 cents a mile. From Vacaville to Sunol would
cost approximately $10.00, 3 times the ram of most public sponsored toll
roads in the U.S.
And, increases would be uriregulated.

5. Them is a nemeived conflict of interest between Cultruns and the Toll Ro~,d

With Callruns as a partner to the franchise agreement, a perceived COntllC't, iS
raised relative to Calm also being the lead agency for the EIR
With respect to other public projects, Calwans has the authority to guaramee--
that new facilities in the franchise zone, which are determined to cornpelt.
with the Toll Road project, will not be built. In fact, it is my belief that thin_
provision is the reason that Callruns is no longer participating in Livernmm's
project.

6. Finally. the Toll Road pro_leer promotes the development of a two-tiered
transoortation system in the Bay Area. The project also raises the question of
how the Toll Road will impact our local streets, in terms of people trying to
avoid the toll.

Your staff report suggests that. Livermore will not be able to complete its Isabel
Expressway without this Toll, Road. For claxification: Ruby Hill will soon b6
settled. Part of the settlement agreement addresses the Southern end of the
Isabel Expressway. Signature Properties has committed $1.7 million to maim
the connection from Concannon to Vallecitos through the Ruby Hill project.

The City also has made plans for completion of the Northern section. We
have in good faith put in place a traffic impact fee ordnance to collect funds
for major traffic improvement projects over a 20 year time period. Dttting
the fu-st 4-5 years, we collected approximately $8 million from this fee. We
have $34 million in our Capital Imporivement budget targeted for th6 years
2000 and 2005.

It is my hope that you will oppose this project as it contradicts California's tradition
of FREEWAYS. At least, you will hopefully oppose public funding of this project.

Once again, thank you.
