REPORTS OF THE CITY ATTORNEY <br /> <br />Item 10a <br />Amendment to the Kaiser Exclusion Aareement (SR93:156) <br /> <br /> Mr. Roush presented the staff report. <br /> <br /> Mr. Pico expressed concern about the finding of Kaiser being <br />local serving rather than regional. <br /> <br /> Mr. Roush explained the history of this "Whereas" in the <br />agreement. He believed that this finding was necessary to be in <br />the agreement if this Council intended to continue this exclusion <br />from the assessments. <br /> <br /> Ms. Dennis requested that language be included in this <br />agreement to indicated the approval process should begin before the <br />year 2000. <br /> <br /> Mr. Pico asked that Section 2(d) be removed and that there be <br />a requirement that would require Kaiser begin the requlatory <br />process for approval by 1998. Kaiser should also pay the permit <br />fees to the City for this project. <br /> <br /> In response to Councilmember's questions, Mr. Roush and Mr. <br />Swift explained that Kaiser would pay a pro-rata amount on the <br />excluded assessment based upon the acreage upon which construction <br />had not commenced. <br /> <br /> CouncilmemBers shared their concerns with the timing of the <br />construction. <br /> <br /> Carol Ireland-McLean, 7601 Stoneridge Drive, representing <br />Kaiser, explained the history of this proposal. She guessed that <br />it would take five years of planning before construction could <br />begin on the hospital. Ms. McLean responded to Ms. Mohr's inquiry <br />regarding the membership base and which areas this hospital would <br />serve. <br /> <br /> Mar. Roush suggested that an amendment to the agreement could <br />be added to state that the hospital must be under construction by <br />the year 2000 but that date could be extended if the City, from the <br />time that the application is complete, takes longer than a year to <br />process. <br /> <br /> It was moved by Ms. Mohr, and seconded by Mr. Pico, approving <br />the First Amendment to the Kaiser Exclusion Agreement but, <br />replacing the last "Whereas" to read as follows: "Whereas, the <br />City continues to believed and finds that the nature of a local <br />nonprofit hospital is considered a significant local benefit and <br />that the hospital to be constructed would not receive special <br />benefit from the proposed NPID improvements." <br /> <br />04/20/93 9 <br /> <br /> <br />
