153 It was moved by Ms. Dennis, and seconded by Mr. Pico, to extend the Subdivision Agreement for Tract No. 6023, Kottinger Ranch, Unit III, Pleasanton, Alameda County, California for 90 days. The roll call vote was as ~olloWs: AYES: Councilmembers Dennis, Mohr, and Pico NOES: Councilmember Scribner ABSENT: Mayor Tarver ABSTAIN: None Ms. Acosta indicated that Council needed to set an interim policy relating to the Growth Management for the 90-day period. Discussion on an Interim Growth Management Policy is to be discussed at a future Council meeting. Item 10c Item 4q License to Zone 7 for the construction of VineVa~d pipeline within City easements and riqhts-of-waV. (SR93:155) Mr. Pico asked what is the legal responsibility of the City to approve this agreement and are there any parts of the unbuilt development in this area that would be negatively impacted if this pipeline were not completed. Mr. Pico had strong reservations about approving this agreement but he understood the need for this pipeline. Mr. Roush was not aware of any legal obligation that the City grant Zone 7 use of our City easements and rights-of-way. The agreement to provide water to Ruby Hill does not obligate the City to grant this agreement. The only issue was the reduction in water quality without the pipeline. Ms. Mohr was concerned that the City of Pleasanton be committed to sub-standard water service as a means of preventing Dublin from exercising its land use authority. Mr. Elliott agreed with Ms. Mohr's statement that this pipeline is designed to better serve the City, not just to Ruby Hill or to Dublin. He further explained that this pipeline is needed whether or not there is any more growth in the City. It was moved by Ms. Mohr, and seconded by Ms. Scribner, approving the license agreement with Zone 7 for the construction of the Vineyard Pipeline within the City easements and right-of way. 04/20/93 11
