153 <br /> <br /> It was moved by Ms. Dennis, and seconded by Mr. Pico, to <br />extend the Subdivision Agreement for Tract No. 6023, Kottinger <br />Ranch, Unit III, Pleasanton, Alameda County, California for 90 <br />days. <br /> <br />The roll call vote was as ~olloWs: <br />AYES: Councilmembers Dennis, Mohr, and Pico <br />NOES: Councilmember Scribner <br />ABSENT: Mayor Tarver <br />ABSTAIN: None <br /> <br /> Ms. Acosta indicated that Council needed to set an interim <br />policy relating to the Growth Management for the 90-day period. <br /> <br /> Discussion on an Interim Growth Management Policy is to be <br />discussed at a future Council meeting. <br /> <br />Item 10c <br />Item 4q <br />License to Zone 7 for the construction of VineVa~d pipeline within <br />City easements and riqhts-of-waV. (SR93:155) <br /> <br /> Mr. Pico asked what is the legal responsibility of the City to <br />approve this agreement and are there any parts of the unbuilt <br />development in this area that would be negatively impacted if this <br />pipeline were not completed. Mr. Pico had strong reservations <br />about approving this agreement but he understood the need for this <br />pipeline. <br /> <br /> Mr. Roush was not aware of any legal obligation that the City <br />grant Zone 7 use of our City easements and rights-of-way. The <br />agreement to provide water to Ruby Hill does not obligate the City <br />to grant this agreement. The only issue was the reduction in water <br />quality without the pipeline. <br /> <br /> Ms. Mohr was concerned that the City of Pleasanton be <br />committed to sub-standard water service as a means of preventing <br />Dublin from exercising its land use authority. <br /> <br /> Mr. Elliott agreed with Ms. Mohr's statement that this <br />pipeline is designed to better serve the City, not just to Ruby <br />Hill or to Dublin. He further explained that this pipeline is <br />needed whether or not there is any more growth in the City. <br /> <br /> It was moved by Ms. Mohr, and seconded by Ms. Scribner, <br />approving the license agreement with Zone 7 for the construction of <br />the Vineyard Pipeline within the City easements and right-of way. <br /> <br />04/20/93 11 <br /> <br /> <br />
