Pleasanton <br /> APPlicatiOn to ~E~ndment Chapter 18.20 of the City of Pleasnaton <br /> Municipal Code to eliminate the Desjan Review Board and transfer <br /> its functions to the Plannina Commission and Zoninu Administrator. <br /> (SR93:69) <br /> <br /> Mr. Swift presented the staff report. <br /> <br /> Mr. Pico asked if there would be any cost to the City to <br /> utilize design professionals on an informal basis. <br /> <br /> Mr. Swift said that has not been determined. <br /> <br /> Ms. Mohr asked if residency would be a requirement if <br /> consultants were to become an advisory only. She then asked how <br /> the Fair Political Practices Act would affect an advisory <br /> consultant. <br /> <br /> Mr. Roush stated that residency would not be a requirement <br /> unless Council so desired. He suggested that staff report back to <br /> Council regarding a program that would address who would be <br /> eligible to participate in this function. The advice that would be <br /> rendered would be informal and to staff only; therefore there would <br /> be no conflict of interest problem. He did not believe that there <br /> would be financial disclosure requirements. <br /> <br /> Mr. Tarver declared the public hearing open on the <br /> application. <br /> <br /> Brian Dutchover, 5579 San Antonio Street, was greatly <br /> concerned that eliminating the Board would compromise the quality <br /> of development in Pleasanton. He asked if there was any legal <br /> reason that the Design Review Board has to be eliminated in order <br /> to reconfigure its responsibilities. He addedthatthe Pleasanton <br /> Chamber of Commerce took a position on the Economic Development <br /> Task Force recommendations in concept only, and did not support the <br /> elimination of the Design Review Board. <br /> <br /> Mr. Roush indicated that the elimination of this Board is a <br /> policy decision. <br /> <br /> Ron Theile, 6111 Johnson Court, #209, Design Review Board <br /> member, spoke in opposition to the elimination of the Board. He <br /> explained that the Design Review Board does not cause delays in the <br /> projects. He felt that one design professional is not adequate. <br /> Other cities have Design Review Boards and have gotten around the <br /> conflict of interest problems. <br /> <br /> Peter Shutts, 4133 Mohr Avenue, Design Review Board member, <br /> also spoke in opposition to the elimination of the Board.
