60 <br /> <br /> Robert Cordtz, 262 West Angela, inquired if this was in <br /> compliance with Division II, Title 23. He expressed concern that <br /> the City's ordinance would be challenged in the future, since the <br /> State ordinance was in place first. He further inquired if the <br /> precipitation was used in the calculations, where is the discharge <br /> statement for the property. The state model ordinance includes a <br /> disclosure statement with the project. <br /> <br /> Ms. Acosta indicated the City ordinance, if adopted, would <br /> supersede the existing state law. She further suggested that <br /> Council provide questions to staff, who may redraft the ordinance, <br /> in response. After Council has reviewed it, the ordinance will go <br /> to the other Commissions. <br /> <br /> It was determined that the ordinance will come back on the <br /> agenda for March 2, 1993. <br /> <br /> The meeting was recessed for five minutes at 9:10 p.m. <br /> <br /> The meeting was reconvened at 9:15 p.m. <br /> <br /> Item 6c <br /> Application for a lower-income exemption to the Growth Manaqement <br /> Program for an approved project consistinq of seven attached <br /> residential units (PUD-g2-8) located at the southeast comer of <br /> Palomino Drive and Concord Street (Pleasanton Rotary North) <br /> (SR 93:36) <br /> <br /> Mr. Swift presented the staff report. <br /> <br /> Mr. Tarver inquired if this exemption were conditioned upon <br /> the City's reaching an agreement with Rotary regarding the sales <br /> price of the units and other conditions. <br /> <br /> Ms. Acosta answered yes. <br /> <br /> Mr. Pico asked if the City would be purchasing the units from <br /> the Rotary and then selling them. <br /> <br /> Ms. Acosta indicated the intent is to have a process in place <br /> so that the transfer between the City and the Rotary occurs on the <br /> same day the ultimate purchasers acquire the property. In the <br /> event the City is not able to locate buyers, the City would in fact <br /> be purchasing the units and reselling them. <br /> <br /> Mr. Pico inquired why this action is being taken before the <br /> agreements are finalized. <br /> <br /> Ms. Acosta indicated it was necessary in order to proceed with <br /> tentative map processing, so as not to delay the project. <br /> <br /> 01/19/93 10 <br /> <br /> <br />
