The area south of Mohr to the <br /> Operations Service Center is being reclaimed and Kaiser Sand and <br /> Gravel plans to develop part of the area as residential. <br /> <br /> Mr. Pico stated that according to the report, the Livermore <br /> airport agrees not to exceed the noise level contours as projected <br /> to the year 2011. What assurances are there that the noise <br /> contours will not be modified? <br /> <br /> Mr. Swift indicated there were no assurances. If residences <br /> are built within the APA and avigation easements were approved, <br /> then so long as the airport operates within the noise contours, the <br /> residents have no recourse for noise complaints. <br /> <br /> Mr. Pico reviewed the takeoff patterns in light of Livermore's <br /> proposed residential development on the northeast corner of the APA <br /> and the existing residential development up to the borders of the <br /> airport. He was concerned that Livermore is not equally sharing <br /> the impacts of the protection area. <br /> <br /> Dan Lee, Chairman of the Livermore Airport Commission, <br /> indicated the major factor in establishing the protection area is <br /> the prevailing winds, which dictate the takeoff direction. He said <br /> 85% of the time the winds are from the west, so pilots are required <br /> to fly towards Pleasanton. When noise complaints are received, the <br /> pilots are asked to cooperate and the noise limitation program is <br /> generally effective. <br /> <br /> He agreed it was a good idea to have a committee composed of <br /> representatives from all jurisdictions. <br /> <br /> With regard to the recommendation to have an environmental <br /> impact report, he indicated the airport is not intensifying the <br /> land use and two legal opinions have indicated a negative <br /> declaration is adequate. <br /> <br /> He reviewed the various proposals for development in the area <br /> and indicated the County wants Zone B to have residences. He was <br /> not in favor of the new shape of the protection area with rounded <br /> corners. He believed it appeared that the airport commission was <br /> accommodating development interests. It was his belief that the <br /> protection area was at a bare minimum now and urged Council to <br /> support the proposal to the ALUC.
